About approval of Instructions for use heat energy

In the republic business entities with different pattern of ownership are engaged in heat supply of consumers. Transition to market conditions led to violation of the system operating long years on providing single technical policy in providing consumers with heat energy.

For the purpose of single approach to questions of use of heat energy by all heatdeveloping and heatsupplying organizations, and also consumers of the Kyrgyz Republic I order:

1. Repeal the order No. 91 of 11.06.08. "About approval of Instructions for use heat energy".

2. Approve the enclosed Instructions for use by heat energy.

3. State inspectorate for power and gas (to Galikeev E. Sh.) carry out registration of this order in the Ministry of Justice of the Kyrgyz Republic.

4. This order becomes effective after passing of state registration by it in the Ministry of Justice of the Kyrgyz Republic and the subsequent official publication.

5. The state inspectorate for power and gas to bring this order to all interested departments.

6. Notify the Ministry of Justice of the Kyrgyz Republic on source of publication of the above-stated order (the name, number, date).

7. Declare invalid the resolution of Executive council of the State agency on power under the Government of the Kyrgyz Republic of January 26, 1999 No. 4-P "About approval of Instructions for use heat energy", registered in the Ministry of Justice of the Kyrgyz Republic on January 27, 1999 for No. 10.

Instructions for use heat energy

1. Are DEVELOPED by the State inspectorate for power and gas under the Ministry of Industry, Energy and Fuel Resources of the Kyrgyz Republic (further - State power inspection), with the assistance of JSC Bishkekteploset, "The state Union of the companies of housing and communal services" (Kyrgyzzhilkommunsoyuz), KP of Bishkekteploenergo, JSC Elektricheskiye stantsii.

2. Are APPROVED by the order of the Ministry of Industry, Energy and Fuel Resources of the Kyrgyz Republic of June 25, 2008 No. 99.

3. Rules establish procedure for use of heat energy and determine relations of the heatsupplying organizations with consumers.

4. Rules are obligatory for the heatsupplying organizations and consumers of heat energy, irrespective of their departmental accessory.

5. Are intended for consumers, specialists and the personnel occupied with operation of systems of heat supply.

6. IN EXCHANGE:

- The instructions for use heat energy approved by the resolution of Executive Council of the State agency on power under the Government of the Kyrgyz Republic of January 26, 1999 No. 4-P, registered in the Ministry of Justice of the Kyrgyz Republic on January 27, 1999 No. 10.

These rules of use of heat energy (further - Rules) are developed according to the Civil code of the Kyrgyz Republic, the Laws "About Power", "About Power Industry", "About Licensing", "About Consumer Protection", "About Privatization of Housing Stock of the Kyrgyz Republic" and determine relations of consumers of heat power (further - the Consumer) and the Heatsupplying and Heat-transmitting organizations.

Chapter 1 Terms and determinations

In the text of Rules the following terms and determinations are used:

Emergency unloading - working hours of the Heatsupplying organization in case of which reduction of leave of heat energy to Consumers is made for the prevention of violation of stability of system operation of heat supply.

Emergency armor - the smallest expense of heat energy ensuring in case of partial or complete stop of the company safety of people, safety of the equipment, work of heating on duty, means of fire safety.

The residential customer of heat energy (population) - the consumer using heat energy on heating and hot water supply of premises.

Intra house system of heat supply (VDS) - set of the interconnected systems of pipelines and individual thermal Item.

State power inspection - the State inspectorate for power and gas under the Ministry of Industry, Energy and Fuel Resources of the Kyrgyz Republic.

Border of balance sheet accessory of thermal networks - the line of the Section of elements of thermal networks between owners on the basis of property or complete economic maintaining.

Transfer and sale of heat energy on regulated tarifuperedacha and sale of heat energy to retail Consumers which is performed by the local Heatsupplying organization for rate which is regulated according to the conditions determined in licenses for transfer, distribution and sale of heat energy by regulated rate.

Having rummaged in giving of heat energy - interruption in supply of heat power in point of connection of the Consumer or the discrepancy of parameters of the heat carrier (fixed by devices) to parameters, the defined Agreement.

The payment document - the payment order, the account or the notice based on which payment by the consumer of heat energy, the performed works, the rendered services of the Heatsupplying organization is made.

The consumer of the heatsupplying organization - the physical person or legal entity, thermal networks and (or) heatinstallations of which are attached to networks of the Heatsupplying organization and the contract for heat supply having with it.

The settlement metering device of heat energy - the metering device, system of accounting based on which indications the consumption of heat energy by the Consumer (Subconsumer) which is subject to payment is determined.

Settlement period - period of time for which the amount of the consumed heat energy is determined and settlement for the consumed heat energy between the Consumer and the Heatsupplying organization is made. The settlement period approved by the parties is specified in the Agreement.

The subconsumer of heat energy is the Consumer to whom heat energy is delivered by the Heatsupplying organization through networks of the main Consumer to whose networks he is attached.

The subconsumer of the heatsupplying organization is the Consumer who is directly attached to thermal networks of the Consumer Heatsupplying the organizations and the Contract for use of heat energy having with him and border of balance sheet accessory.

The heatsupplying organization (Licensee supplier) - the company (or the organization), being the legal entity and having in property or in complete economic conducting installation, the generating heat energy, thermal networks and providing transfer of heat energy to consumers on contractual basis.

The heat-transmitting organization (Licensee transmitter) - the company (or the organization), being the legal entity and having thermal networks in property or complete economic maintaining. The heat-transmitting organization will be for the Consumer the Heatsupplying organization if the Consumer is connected directly to its thermal networks.

Authorized state body of the Kyrgyz Republic in the field of power - the state body of the Kyrgyz Republic authorized by the Government for control and regulation of the relations in the field of power.

Force majeur circumstances - the events caused by circumstances extraordinary and insuperable in this situation, natural disasters (earthquakes, fall of meteorite, storm, lightning, the fire, flood, snow drifts, ice, etc.) and other events which action cannot be anticipated by means of practice of highly professional personnel.
