1. In case of receipt in the Ministry of Justice of the Republic of Belarus of the written address containing data on red tape or on suspension, adjournment of civil, criminal case, case on administrative offense (further - legal cases) on the bases which are not provided by the Code of civil procedure of the Republic of Belarus, the Code of penal procedure of the Republic of Belarus, the Procedural and executive code of the Republic of Belarus about administrative offenses carries out preliminary inspection of the arrived information.
2. According to the procedure of preliminary verification of data on red tape or illegal suspension, adjournment of legal case explanations of the judge and other persons, required materials and documents (further - materials), and also materials of legal cases, including legal cases are requested.
3. Reclamation of legal cases and materials, written explanations of the judge and other persons is performed by means of the direction of the written requirement of the Minister of Justice of the Republic of Belarus, his deputies about the direction of legal case and written explanations (daleetrebovaniye). The requirement is addressed to the chairman of the relevant court.
4. Claimed legal cases and materials go court no later than the next day from the date of receipt of the requirement to court if at the order (requirement) other term is not established.
