1. Approve enclosed:

1) Regulations of work of information system of purchases of goods, works and services when carrying out transactions in subsurface use;

2) the Standard agreement of registration of the supplier and confidentiality of the provided information;

3) the Standard agreement of registration of the customer and confidentiality of the provided information.

2. Declare invalid the order of the Minister of the industry and trade of the Republic of Kazakhstan of July 20, 2007 No. 225 "About approval of Regulations of work of the information system "The Register of Goods of the Works and Services Used when Carrying Out Transaction on Subsurface Use and Their Producers".

3. Provide to Kazakhstan Contractual Agency joint-stock company forming and maintaining information system of purchases of goods, works and services when carrying out transactions in subsurface use.

4. To impose control of execution of the order on the vice-minister of the industry and trade of the Republic of Kazakhstan Mamytbekov E. K.

5. This order becomes effective from the date of signing.

Regulations of work of information system of purchases of goods, works and services when carrying out transactions in subsurface use

Section 1. Procedure for forming and functioning of system

Chapter 1. General provisions

1. These Regulations of work of information system of purchases of goods, works and services when carrying out transactions in subsurface use (further - Regulations) are developed for the purpose of ensuring efficiency of its work. The regulations regulate procedure for functioning and work of participants of information system of purchases of goods, works and services when carrying out transactions in subsurface use.

2. The concepts used in these Regulations have the following values:

information system of purchases of goods, works and services when carrying out transactions in subsurface use (further - system) information system for maintaining the register of the goods, works and services used when carrying out transactions on subsurface use and also for forming of registers of customers and suppliers and information on the purchases which are carried out by them and the signed agreements, reports and analytical information;

the customer - the subsoil user, and also person authorized by the subsoil user to perform purchase of goods, works and services for carrying out transactions in subsurface use, registered in system and carrying out work on forming of the annual program of purchase and carrying out purchases;

the supplier - the physical person or legal entity registered in system and participating in process of purchases of the goods, works and services used when carrying out transactions on subsurface use for the purpose of the conclusion of the agreement;

the user - person who uses system including performs viewing of its website;

the operator of system - the person determined by authorized body in the field of state regulation of industrial and trade policy, acting on its own behalf and within the powers delegated by authorized body who provides functioning of system;

the controller - Committee of the industry and scientific and technical development of the Ministry of the industry and trade of the Republic of Kazakhstan.

3. The system is created on the basis of information provided by customers and suppliers (further - the registered users).

Providing confidentiality terms of information provided by the registered user and observance of these Regulations from the registered user of system is determined by means of the conclusion of the agreement of registration and confidentiality of the provided information between the operator of system and the registered user.

Chapter 2. Organization of management of system

4. Preparation and placement of information in system are provided by the registered users and the operator of system according to the functional roles.

5. Technical support of functioning of system is provided by the relevant division of the operator of system.

Chapter 3. Structure of system

6. The system consists of the opened and closed parts.

7. Open part of system is available to all users and does not require registration. Open part of system includes the general block and the block of registers of system.

The general block contains the following information: news, legislation, contacts, references and other information, useful to the user.

The block of registers consists of the following Sections:

1) Catalogue of goods, works and services;

2) the Register of customers containing lists of the customers registered in system;

3) the Register of the suppliers containing supplier lists, registered in system.

4) the Register of the goods, works and services used when carrying out transactions on subsurface use and their producers.
