About the List of monuments of cultural heritage, not privatizeable

The Verkhovna Rada of Ukraine decides:

I. Approve the List of monuments of cultural heritage, not privatizeable (it is applied *).

II. Final provisions

1. This Law becomes effective from the date of its publication.

2. Make changes to the following laws of Ukraine:

1) the paragraph the fifth parts two of article 4 of the Law of Ukraine "About lease of the state-owned and utility property" (Sheets of the Verkhovna Rada of Ukraine, 1995, N 15, Art. 99; 1998, N 49, Art. 301; 2004, N 50, Art. 539; 2006, N 8, 89) after words of "the Law of Ukraine "On privatization of state-owned property" to add the Art. with words "(except monuments of cultural heritage)";

2) in the Law of Ukraine "About protection of cultural heritage" (Sheets of the Verkhovna Rada of Ukraine, 2000, N 39, Art. 333; 2005, N 5, Art. 114):

to add the paragraph of the sixth Article 1 after the word of "monument" with words "cultural heritage (further - monument)";

to add article 18 part one after paragraph two with the new paragraph of the following content:

"The monument can be privatized only on condition of the conclusion by future owner with relevant organ of protection of cultural heritage of the provisional agreement about the conclusion in the future of the security contract for monument (its part) with statement of its essential conditions, including on target use of monument, works which future owner shall carry out on monument for the purpose of content it in proper condition".

With respect thereto third - the fourth to consider paragraphs respectively paragraphs the fourth - the fifth.

3. Declare invalid the Law of Ukraine "About temporary prohibition of privatization of monuments of cultural heritage" (Sheets of the Verkhovna Rada of Ukraine, 2005, N 11, the Art. 201).
