in view of the principles underlain in the main documents of the UN on human rights, in particular in the Universal Declaration of Human Rights, International covenants on human rights;

being guided by provisions of the Helsinki Final act, and also the subsequent documents of the Organization for Security and Co-operation in Europe;

according to provisions of the Convention on liquidation of all forms of racial discrimination, the Convention on liquidation of all forms of discrimination of women, the Convention on the Rights of the Child, and also the international legal standards containing in the documents developed within the International Labour Organization;

confirming that any forms of discrimination of people, in particular on political, social and economic, ethnic and religious signs, in connection with realization of their right to free resettlement between the Russian Federation and the Republic of Tajikistan are obstacle to the friendly and peace relations between the nations and can lead to breach of the peace and safety among the people, and also harmonious coexistence of people in the same state,

agreed as follows:

Part 1. Determination and scopes of application

Article 1

This agreement extends to the persons moving from the Republic of Tajikistan to the Russian Federation and from the Russian Federation to the Republic of Tajikistan.

Resettlement is performed on the basis of free declaration of will. The parties recognize inadmissible any direct or indirect coercion to resettlement.

Action of this agreement to each particular person is single.

Article 2

The terms used in this agreement are understood as follows:

"immigrant" is the person who is voluntarily leaving the state of the permanent residence and moving to the permanent residence on the territory of other state.
