About the taxation of the high-technology organizations

For the purpose of creation of conditions for technical retrofitting of the productions based on new and high technologies:

1. Approve the enclosed list of the high-technology organizations included in the Register of high technology productions and the companies, which profit received from realization of high-technology goods (works, services) of own production (except trade and trade purchasing activity) it is assessed with the income tax at the rate reduced by 50 percent (further - the list).

2. Determine that:

2.1. for the purposes of this Decree products made with use of the high technology productions which passed the state scientific and technical examination in the procedure established by the legislation belong to high-technology goods (works, services);

2.2. the means released as a result of provision of privilege according to Item 1 of this Decree go the organizations determined in the list for financing of technical retrofitting of data of the organizations. In case of inappropriate use of these means their taxation is made according to the procedure, established by the legislation;

2.3. in case of exception of the organizations determined in the list of the Register of high technology productions and the companies they lose the right to application of privilege on the income tax from the date of their exception of the called Register.

3. To the state committee on science and technologies to draw the conclusions about reference of goods (works, services) to high-technology.

4. To Council of Ministers of the Republic of Belarus till January 1, 2009 to take measures for implementation of this Decree.

5. This Decree becomes effective since January 1, 2009, except for item 4 and this Item which are becoming effective from the date of signing of this Decree.
