About approval of the Instruction of conducting office investigation

For the purpose of implementation of single procedure for conducting office investigation concerning government employees and according to article 32 of the Law of the Republic of Tajikistan "About public service" I decide:

1. Approve the enclosed Instruction of conducting office investigation.

2. To heads of the central and local authorities of the government, self-government institutions of the settlement and villages in case of involvement of government employees of the bodies to disciplinary responsibility to follow requirements of this Instruction.

Instruction of conducting office investigation

1. The instruction of conducting office investigation (further - the Instruction) regulates procedure for conducting office investigation concerning government employees of the Republic of Tajikistan.

2. For the purpose of determination of circumstances of non-execution or improper execution of job responsibilities by the head of state body office investigation is appointed. Office investigation can be appointed also upon the demand of the government employee.

3. Office investigation is activities for collection and verification of data on minor offense of the government employee which is carried out for the purpose of complete, comprehensive and objective clarification of circumstances of making of minor offense.

4. If the government employee is recognized making of minor offense and regrets deeds, then the head of state body having the right of position assignment (representation - for the chosen positions) and dismissal and/or having the right to conducting office investigation and imposing of authority punishment (daleerukovoditel of state body) has the right to impose penalty on it in the form of the note or reprimand without conducting office investigation to position.
