Article 1. Regulation subject

This Federal Law according to the Civil code of the Russian Federation governs the relations connected with activities in the territory of the Russian Federation of patent agents, determines requirements to patent agents, establishes procedure for acquisition of the status of the patent agent, including procedure for certification and registration of patent agents, and also determines the rights, obligations and responsibility of patent agents.

Article 1.1. Status of the patent agent

1. The status of the patent agent is given to persons who confirmed availability of necessary qualification and work experience in the field of activities of the patent agent according to specialization in relation to which the citizen expresses desire to be certified and registered as the patent agent, and to relevant requirements of this Federal Law. Activities of the patent agent are aimed at providing necessary level of protection of the rights and legitimate interests of the principal. Principals of the patent agent are applicants, owners and other interested citizens and legal entities with whom the patent agent (the employer of the patent agent) signed the agreement including conditions about performance of works (about rendering services), belonging to activities of the patent agent.

2. The status of the patent agent is acquired from registration date of the patent agent in the Register of patent agents of the Russian Federation (further - the Register) and stops from the date of exception of the patent agent of the Register based on Items 1 - 5 parts 1 of article 8 of this Federal Law or from the date of the introduction in legal force of the judgment specified in Item 6 of part 1 of article 8 of this Federal Law.

3. In the cases and procedure provided by part 2 of Article 8 and Item 2 of part 2 of article 10 of this Federal Law, the status of the patent agent excluded from the Register is recovered.
