About some questions of application by courts of the Republic of Kazakhstan legislations on bankruptcy
By results of generalization of court practice and for the purpose of uniform interpretation and application of regulations of the current legislation about bankruptcy in connection with the questions arising at courts, the plenary session of the Supreme Court of the Republic of Kazakhstan DECIDES:
1. Draw the attention of courts that the legislation on bankruptcy is based on the Constitution of the Republic of Kazakhstan consists of the Civil code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About bankruptcy" (further - the Law), other laws and regulatory legal acts establishing features of application of insolvency proceedings concerning certain business entities.
2. According to article 2 of the Law of feature of application of insolvency proceedings concerning certain business entities depending on their legal status and activity can be established by the legislation of the Republic of Kazakhstan.
Features of forced reorganization and liquidation of banks and insurance (reinsurance) organizations are established by the bank law and the legislation on insurance and insurance (reinsurance) activity.
The bases of involuntary judicial liquidation of the cereal-receiving companies, features of realization of competitive weight and priority of satisfaction of requirements of creditors are provided in the Law of the Republic of Kazakhstan "About grain".
