Chapter I. General provisions

Article 1. Concept of local poll of opinion

Local poll of opinion is studying of opinion of the citizens living in the municipal territory on questions of local value.

Article 2. The questions submitted for local poll of opinion

The questions of local value carried by the Constitution and the legislation of the Azerbaijan Republic to powers of municipalities can be submitted for local poll of opinion.

Article 3. The questions prohibited for removal at local poll of opinion

The questions which are not carried by the Constitution and the legislation of the Azerbaijan Republic to powers of municipalities, the questions pursuing the exit aim from district and city administrative-territorial structure of municipality, declaration of autonomy, change of the borders of municipalities established by the state, restrictions of rights and freedoms of man and citizen, damnifications to historical, cultural monuments and reserves cannot be submitted for local poll of opinion.

Article 4. Legal force of results of local poll of opinion

For the introduction of results of local poll of opinion in legal force the municipality shall make the relevant decision. The basis of this decision is made by results of local poll of opinion. The decision of municipality has binding legal force in the municipal territory.

Article 5. Principles of holding local poll of opinion
