proceeding from provisions of the Trade agreement between the Government of the Russian Federation and the Government of Ukraine of October 22, 1992,

considering mutual interest in strengthening of defense capability of the countries,

at the same time understanding need of preserving and development of commercial ties which developed between the companies and the organizations of the Parties,

agreed about the following:

Article 1

The parties through the authorized organizations will take measures for implementation of mutually beneficial bilateral military and technical cooperation in the way:

preserving and developments of the cooperated bonds in case of development and production of military products;

implementation of mutual deliveries of military products;

rendering military services.

For this purpose each of the Parties according to the national legal system will provide creation of necessary organizational, legal and other conditions for the conclusion between authorized business entities of contracts (agreements) in the specified forms of military and technical cooperation.

Article 2

The nomenclature and amounts of mutual deliveries of products and military services, conditions of deliveries, procedure of payments for such deliveries will be determined by annual bilateral intergovernmental agreements, and also other contractual documents signed on the basis of these agreements.

Article 3

The parties will not sell or transfer to the third party, including foreign to physical, legal entities or the international organizations the military products provided by one Party to other Party and information on her without the preliminary, obviously expressed consent of their initial owner.
