About approval of the Technical regulation "Requirements to Safety of Agricultural and Logging Tractors, Trail Cars and Machines"

For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of Agricultural and Logging Tractors, Trail Cars and Machines".

2. This resolution becomes effective after twelve months from the date of the first official publication.

Technical regulation "Requirements to Safety of Agricultural and Logging Tractors, Trail Cars and Machines"

1. Scope

1. Requirements of this Technical regulation "Requirements to Safety of Agricultural and Logging Tractors, Trail Cars and Machines" (further - the Technical regulation) extend to the new and upgraded tractors, tractor trail cars, semitrailer trucks and machines for rural and forestry (further - machines), made in the Republic of Kazakhstan and imported from abroad.

The list of the machines falling under action of this Technical regulation, and their codes on the qualifier of the Commodity nomenclature of foreign economic activity of the Republic of Kazakhstan (further - the Commodity Nomenclature of Foreign Economic Activity of RK) are specified in appendix 1 to this Technical regulation.

2. Requirements of this Technical regulation do not extend to the machines imported on the territory of the Republic of Kazakhstan for the term of no more than two months or placed under customs regimes which do not provide possibility of alienation.

3. The list of the dangers to life and human health and the environment created by machines in use in relation to which safety requirements of this Technical regulation are applied are specified in appendix 2 to this Technical regulation.

2. Terms and determinations

4. In this Technical regulation the main terms used in the Laws of the Republic of Kazakhstan "About technical regulation" and "About safety of machines and the equipment" and also the following terms and determinations are applied:

the machine hinged - the machine fixed on three-point hinged system of the tractor or energy means which mass in transport provision is completely perceived by energy means;

intended wrong application - the use of the machine which is not provided by the manufacturer, but easily predictable based on general patterns of behavior of the person;

the upgraded machine - the machine to which design for the purpose of its improvement changes in conditions of serial production were made;

the machine semi-hinged - the machine which mass in transport provision is partially perceived by the tractor or energy means and mostly own wheels. In case of transfer of the machine from working provision in transport the hinged point of accession to energy means compulsorily moves to new provision on height;

the machine semitrailer - the machine which mass in transport provision is partially perceived by the tractor or energy means and mostly own wheels. In case of transfer of the machine from working provision in transport the hinged point of accession to energy means does not change the provision on height;

point To - reference point of parameters of visibility of rather control point of seat;

protective barrier - the part of the machine which is specially intended for ensuring protection in the form of physical barrier;

the protection device - the additional equipment (which is not protective barrier), reducing risk both in case of separate application, and together with protective barrier;

application to destination - use of the machine according to the appointment specified by the manufacturer by this machine and (or) in operational documents;

"weight" - the carrying-out body which electric potential is accepted for basic;

the machine mounted - the machine fixed on three-point hinged system and (or) on other points of the tractor or energy means with additional installation of number of assembly units which mass is completely perceived by energy means;

the motor-block - the uniaxial small-size tractor intended for the drive of replaceable hinged and trailing machines and tools;

the operator - person (persons) responsible for operation and maintenance of the machine;

control point of seat (further - KTS) - basic reference point of parameters of workplace of the operator;

elastic element of suspension bracket of seat - the seat suspension bracket node disseminating fluctuations;

self-propelled machines - the machines used in rural or forestry on wheel or caterpillar the internal combustion engine is the course which process of functioning provides movement without the aid of foreign energy means and power source;

semitrailer truck tractor - not driverless vehicle transmitting part of vertical load of the bearing area through the wheels and part of load of the tractor or energy means via the traction coupling device;

trail car tractor - not driverless vehicle transmitting all vertical load of the bearing area through the wheels;

tractors - motorized vehicles on wheel or caterpillar to the course, the having at least two axes which functional purpose depends generally on its traction effort and which are designed mainly for towage, pushing, transportation or actuating of certain devices, mechanisms or trail cars, held for use in rural or forest farms;

the machine trailing - the machine fastened to the tractor or energy means which mass in transport provision is perceived by its tradable system;

mobile machines - tractors, self-propelled machines, and also the trail cars towed by them, machines or tools used in rural or forestry;

mobile means of small-scale mechanization - the hinged, trailing, semi-hinged and semitrailer farm vehicles and tools aggregated with small-size tractors and motor-blocks, constituting the agricultural aggregate, specialized machines and tools: self-propelled, working in movement and managed by row the going operator with internal combustion engines capacity to 25 kW;

the small-size tractor - the tractor having the engine capacity no more than 25 kW intended for accomplishment of agricultural and forestry and landscape works on sites, allotments, terraces, gardens, farms in park and utility farms;

energy means (further - power means) - set of the engine, transmission and the propeller intended for draft (pushing) of not self-propelled machines and the drive of their working bodies.

3. Conditions of placement of machines in the market to the Republic of Kazakhstan and their input in operation

5. Necessary condition of placement of machines in the market or commissioning is compliance to the requirements established by this Technical regulation.

6. The machines coming to the market and put into operation in the Republic of Kazakhstan shall meet safety requirements during all service life established by the manufacturer in case of accomplishment by the consumer of the requirements established in operational documentation.

7. The complete and reliable information given is provided to consumers of machines:

1) in marking of machines and their main assembly units;

2) in the accompanying documentation.

8. By machines the marking and texts containing the following information shall be put:

1) name of the machine;

2) name of the manufacturer;

3) designation of series, type, model;

4) serial number;

5) number of the engine, number of frame, numbers of aggregates specified in the passport of self-propelled machines;

6) date of production;

7) requirements about need of use of individual protection equipment of the operator;

8) designation of places for accession of load-lifting means and installation of jacks;

9) the signs warning about danger;

10) the data relating to adjustment of working bodies and devices of protection;

11) for self-propelled machines - permissible load on wheels, distribution of weight on axes.

Information placed directly on machines shall be read during fixed term of its service.
