About the Concept of forming and functioning of the mechanism of peacekeeping organization activity of the Agreement on collective security

Council of collective security of the Collective Security Treaty Organization,

confirming interest of state members in providing on collective basis of safety and stability in zone of responsibility of the organization of the Agreement on collective security (further - the Organization) and adjacent regions,

declaring further commitment to the purposes and the principles enshrined in the Charter of the UN and also to the commonly accepted rules of international law,

proceeding from importance of increase in role of the Organization in efforts of the world community on prevention and settlement of conflict situations in the world,

considering the necessary resource and experience in carrying out peacekeeping transactions which are available for the Organization and its state members,

solved:

1. Approve provided by the Secretary general of the Collective Security Treaty Organization (further - the Secretary general) the Concept of forming and functioning of the mechanism of peacekeeping organization activity of the Agreement on collective security (is attached);

2. Taking into account the reasons and recommendations stated in the Concept to charge to the Permanent Council under the Organization together with the Secretary general and the Chief of the Integrated headquarters of the Organization to prepare till October 1, 2004 document package on normative and organizational registration within the Organization of the mechanism of peacekeeping activities, including the projects of Provisions and decisions mentioned in the Concept and to submit them in accordance with the established procedure for consideration of Council of collective security.

It is made in the city of Astana on June 18, 2004 in one authentic copy in Russian. The authentic copy is stored in the Secretariat of the Collective Security Treaty Organization which will send to each state member of the Collective Security Treaty Organization its verified copy.

Concept of forming and functioning of the mechanism of peacekeeping organization activity of the Agreement on collective security

1. The basic line of state members of the CSTO on ensuring the regional and international security with collective efforts according to the Charter of the UN, decisions of the UN Security Council, the universally recognized norms of international law is the basis.

In achievement of these state members and the Organization in general are more whole assume active participation in peacekeeping multicomponent transactions under the auspices of the UN, multinational and regional transactions with use of the armed forces performed according to the decision of the UN Security Council made according to the Charter of the UN for elimination of threat to peace, violations of the world or act of aggression. Possible obligations within the CSTO do not narrow the right of state members to their participation in activities of other international organizations.

2. State members, building the mechanism of peacekeeping activities of the CSTO, consider it essentially important stage of early detection and timely prevention by political means of the imminent military-political crises and the military conflicts.

3. State members recognize that the probability of emergence of the conflicts on the basis of political, economic, religious and ethnic, territorial and other contradictions remains high, both their reliable prevention and peaceful settlement without use of peacekeeping technologies is represented impracticable. Participation of state members in peacekeeping processes has key value for promotion of military-political line items and interests both the states, and the CSTO in general in the international cases.

4. In peacekeeping activities state members of the CSTO are guided by provisions of the Charter of the UN, regulations and the principles of the international and national law.

5. Declaring the intention to create necessary peacekeeping potential within the CSTO, state members consider it expedient to concentrate these activities on such range of peacekeeping transactions as peace support operations (OPM) in their traditional context, carried out in the zones having important strategic importance for state members of the CSTO.

In case of accomplishment of the functions the personnel of such transactions have the right to use weapon for the purpose of safety and protection against any infringement of his life and health according to the procedure of implementation of the inalienable right to self-defense: in case of attempts of violent discharge of personnel of transactions from accomplishment of the functions assigned to it, for reflection of explicit armed attack of terrorist, diversionary groups and bands, and also for their detention and for protection of the civilian population against violent infringement of their life and health in zone of responsibility of peacekeeping forces, and also in cases of participation in transactions of the UN according to the mandate approved by UNSC.

6. Peace support operations are undertaken from direct consent involved in conflict of two sides, performed in the spirit of impartiality, on condition of safety of the peacekeeping contingent, their neutrality and openness, recognition of powers of local authorities.

Participation of state members in OPM has exclusively voluntary nature.

7. Transactions of the CSTO on peacekeeping will be performed in strict accordance with provisions of the Charter of the UN. Preliminary comprehensive preparatory work will be carried out at the same time. At all stages experience, special knowledge and resources of the UN and OSCE, other international structures can be used. The CSTO can appeal to them about provision of necessary resources for the purpose of rendering support in implementation of the activities for peacekeeping to it. Decisions are in this respect made by Council of collective security for the recommendation of Councils of Foreign Ministers and defense.

The acting Chairman of the board of collective security of the CSTO will send without delay exhaustive information to the UN Security Council on the peace support operations performed by the CSTO.

8. In the peacekeeping activities the CSTO will rely on specially prepared peacekeeping contingents which are available for state members. The state members which expressed readiness to participate in OPM communicate about the number and structure of the peacekeeping forming which are available for them arms and military equipment and also will take measures to their possible fitting according to in advance approved program for the purpose of achievement of necessary compatibility and complementarity of the national contingents when carrying out collective peacekeeping transactions.

9. State members will consider the possibility and feasibility of forming of the Collective Peacekeeping Forces (CPF). Will be their part:

* Joint command;

* military units (divisions);

* groups of military observers;

* group of experts;

* divisions of police (militia);

* parts (division) of fighting, technical and logistic support;

* other bodies and divisions providing accomplishment of objectives.

Means that KMS created in the CSTO can be developed in conflict zone after adoption of the political decision.

State members recognize that national peacekeeping divisions are deployed in the territories, have training according to single programs, including taking into account standards of NATO, also bonds are equipped with single samples of arms, submit to national management, are involved in regular joint exercises.

The number and structure of KMS, circle of the tasks assigned to them, conditions of their expansion in zone of the conflict and procedure for accomplishment of peacekeeping transactions by them are determined in separate Regulations on KMS approved by Council of collective security.

10. For carrying out monitoring of military-political situation in zone of responsibility of the CSTO and other regions, information and analytical providing OPM, preparation of offers, recommendations and drafts of decisions on application of KMS and their separate elements the Task working group of officials of the Secretariat and the Integrated headquarters of the CSTO with the assistance of members of the Permanent Council under the Organization - Plenipotentiaries of state members is created. Also the organization of reconnaissance in zone of expansion of KMS and preparation of the report on opportunity and feasibility of carrying out OPM, their amounts and terms is assigned to Task force.

Tasks and functions of the Task working group are regulated by the separate Provision approved by Council of collective security.

11. For the purpose of ensuring combat readiness of KMS, the organization of their study, due preparation of OPM and management of actions of peacekeeping parts (divisions) in case of their carrying out the Governing body under control to bodies of the CSTO is created. Its structure, tasks and functions are determined by the separate Provision approved by Council of collective security.

12. State members will charge to the relevant state bodies to develop and submit in accordance with the established procedure for consideration of Council of collective security of the offer on financial aspects of collective peacemaking, including procedure for cost allocation on preparation and carrying out specific OPM between state members.

13. The decision on carrying out peace support operation of the CSTO is made by Council of collective security for the offer of SMID and SMO based on decisions of the state members made in accordance with the established procedure.

Council of collective security approves further the Mandate of OPM, appoints the Commander of KMS, and also Chapter of peacekeeping mission who according to the order and on behalf of Council of collective security exercises political control over the implementation of OPM, including by direct participation in political settlement.

With the consent of Council of collective security peacekeeping forces of the CSTO can take part in the peace support operations which are performed on the basis of the relevant resolution of UNSC.

14. Each state member having the reserve agreement with the UN has the right to unrestricted participation of the peacekeeping contingents in OPM under the mandate of the UN or under the auspices of OSCE, informing Council of collective security on possible participation.

At the same time the CSTO proceeds from possibility of the conclusion of the collective reserve agreement with the UN with participation in it of the interested state members. At the same time already available practice of the UN and the preference fixed in number of documents of the UN for participation in OPM of well structured multinational forming with necessary forces of providing created by the state members acting on the collective basis is considered. Thereby use from the sanction of the UN Security Council of national forming is facilitated and stimulated in peacekeeping transactions under the flag of the UN and OSCE.

15. State members will make efforts to harmonization of the national legal system on peacemaking according to the decision of Council of collective security made in this respect.
