About some questions of application to lawyers of measures of disciplinary responsibility

Based on article 31 of the Law of the Republic of Belarus of June 15, 1993 "About legal profession", for the purpose of the prevention of violations by lawyers of the legislation on legal profession, the Ministry of Justice of the Republic of Belarus DECIDES: ensuring strict observance by lawyers of requirements of the legislation on rendering legal aid

1. Determine that:

1.1. violation by the lawyer of requirements of the current legislation according to article 19 of the Law of the Republic of Belarus of June 15, 1993 "About legal profession" (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1993, No. 20, 242) attracts with the Art. application of measures of disciplinary responsibility, stipulated by the legislation about legal profession;

1.2. excitement and hearing of cases about disciplinary responsibility of the lawyer, application of authority punishments, the solution of questions of early withdrawal of authority punishments are performed by Presidium of regional, Minsk city, Specialized Belarusian Bar (further - Presidium of Bar).

General meeting (conference) of regional, Minsk city, Specialized Belarusian Bar performs powers in case of excitement and hearing of cases about disciplinary responsibility of lawyers according to the charter of the relevant Bar;

1.3. the basis for initiation of disciplinary production are:

idea of the Ministry of Justice of the Republic of Belarus of attraction to disciplinary responsibility;

representation of the body conducting criminal procedure, private determination (message) of court (judge);
