About control of export from the Russian Federation to Iraq of the goods and dual-use technologies and other means falling under operation of the international mechanism of permanent observation and control

1. Approve the enclosed Regulations on control of export from the Russian Federation to Iraq of the goods and dual-use technologies and other means falling under operation of the international mechanism of permanent observation and control.

2. Recognize to invalid:

the order of the Government of the Russian Federation of November 7, 1997 N 1403 "About control of export to Iraq of the goods and dual-use technologies and other means falling under operation of the international mechanism of permanent observation and control" (The Russian Federation Code, 1997, N 46, the Art. 5315);

item 4 of changes which are made to decisions of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of August 29, 2001 N 635 "About change and recognition voided some regulatory legal acts of the Government of the Russian Federation regulating questions of export control" (The Russian Federation Code, 2001, N 37, the Art. 3684).

3. Determine what regulatory legal acts of the Government of the Russian Federation concerning export control concerning the controlled goods and technologies included in the List of goods and dual-use technologies and other means which export to Iraq according to resolutions of the UN Security Council is controlled which are taken out to Iraq and is subject to the notification or it is prohibited, approved by the Presidential decree of the Russian Federation of September 2, 1997 N 972 "About measures for accomplishment of resolutions of the UN Security Council by the Russian Federation concerning creation of the international mechanism of permanent observation and supply control to Iraq" (The Russian Federation Code, 1997, N 36, Art. 4128), are applied in the part which is not contradicting Regulations on control of export from the Russian Federation to Iraq of the goods and dual-use technologies and other means falling under operation of the international mechanism of permanent observation and control approved by this resolution.

4. To federal executive bodies to perform interaction with the Commission of the UN on observation, control and inspectorates and International Atomic Energy Agency on the questions connected with functioning of the international mechanism of permanent observation and control concerning Iraq through the Ministry of Foreign Affairs of the Russian Federation.

Regulations on control of export from the Russian Federation to Iraq of the goods and dual-use technologies and other means falling under operation of the international mechanism of permanent observation and control

1. This Provision determines procedure of control of export from the Russian Federation to Iraq of the goods and technologies included in the List of goods and dual-use technologies and other means which export to Iraq according to resolutions of the UN Security Council is controlled and is subject to the notification or is prohibited, approved by the Presidential decree of the Russian Federation of September 2, 1997 N 972 "About measures for accomplishment of resolutions of the UN Security Council by the Russian Federation concerning creation of the international mechanism of permanent observation and supply control to Iraq" (further respectively hereinafter are referred to as - the List, controlled goods and technologies).

2. Export from the Russian Federation to Iraq of the controlled goods and technologies which are military products is performed in accordance with the legislation of the Russian Federation about military and technical cooperation.

3. This Provision is obligatory for execution by all Russian participants of foreign economic activity when implementing the external economic transactions connected with export to Iraq of controlled goods and technologies.

4. Control of export from the Russian Federation to Iraq of controlled goods and technologies includes:

allowing procedure for export from the Russian Federation to Iraq of controlled goods and technologies;

customs control and customs clearance of the controlled goods and technologies moved through customs border of the Russian Federation if other is not established by the legislation of the Russian Federation;

representation to Joint group of the Commission of the UN on observation, control and inspectorates and International Atomic Energy Agency (further hereinafter is referred to as - Joint group) information on export from the Russian Federation (except export in the transit mode) to Iraq of controlled goods and technologies.
