About obligatory civil liability insurance of owners of vehicles in the Azerbaijan Republic
This Law governs the relations in insurance field of the civil responsibility of owners of vehicles before the third parties (further - "insurance"), determines procedure for the conclusion of the insurance agreement, payment of insurance premiums and insurance indemnities.
Civil responsibility insurance of owners of vehicles in the Azerbaijan Republic is obligatory.
Obligatory civil liability insurance of owners of vehicles is performed for the purpose of collateral security of social protection of the population, the timely indemnification caused to property of physical persons and legal entities and health of citizens by the road accidents with participation of vehicles with the engine.
The insurer - the legal entity having in stipulated by the legislation procedure the license for occupation insurance activity, who got from body of insurance supervision the corresponding permission by sight of obligatory civil liability insurance of owners of vehicles.
1. The insurer - the insurance agreement party which is paying insurance premium, having insurance interest in civil responsibility insurance in connection with operation of the vehicle specified in this agreement.
2. Insured - person whose valuable interests are insured, regardless of on what name the appropriate certificate of compulsory insurance and who uses on legal causes by the vehicle which civil responsibility of the owner is insured according to this Law is granted.
3. For the purpose of this Law person who is owner of the vehicle is considered the vehicle owner, or performs actual possession by the vehicle, that is leases it or manages on the basis of the power of attorney, or operates on other legal causes. The vehicle owner is free in the choice of the insurer.
