About approval and enforcement of the Labor code of Turkmenistan

Article 1. Approve the Labor code of Turkmenistan.

Article 2. Enact the Labor code of Turkmenistan since July 1, 2009.

Article 3. From the date of the introduction in action of this Code to recognize invalid the following legal acts:

1) the Labor code of Turkmenistan approved by the Law of Turkmenistan of June 28, 1972 with changes and additions made by Majlis of Turkmenistan as of October 1, 1993, all subsequent laws or their corresponding parts which made changes and additions to it;

2) the Law of Turkmenistan "About labor protection", adopted by Majlis of Turkmenistan on October 1, 1993, all subsequent laws or their corresponding parts which made changes and additions to it;

3) the Law of Turkmenistan "About leaves", adopted by Majlis of Turkmenistan on June 12, 1997, all subsequent laws or their corresponding parts which made changes and additions to it.

Article 4. Action of the Labor code of Turkmenistan extends to the employment relationships which arose after its introduction in action.

If employment legal relationship arose before enforcement of this Code, then he is applied to those rights and obligations which will arise after its introduction in action. In cases of their contradiction or deterioration of the situation of legal and (or) physical persons of the party of the employment contract apply provisions of this Code.

Article 5. Until reduction of the laws and other regulatory legal acts of Turkmenistan in compliance with the Labor code of Turkmenistan they act so far as do not contradict the Labor code of Turkmenistan.

Article 6. To the Cabinet of Ministers of Turkmenistan in three-months time to bring regulatory legal acts of Turkmenistan into accord with the Labor code of Turkmenistan.
