About perpetuating of name of the martyr and about privileges to families of martyrs
This Law serves the purpose of regulation of the status and social protection of persons, dead, missing persons and in the procedure established by the law who are considered as the dead in connection with military operation for freedom, sovereignty and territorial integrity of the Azerbaijan Republic, their families.
The martyr is the person who died, missing and in the procedure established by the law considered as the dead in connection with military operation for freedom, sovereignty and territorial integrity of the Azerbaijan Republic.
According to the current legislation the following persons are considered as members of the family of the martyr:
spouses, parents;
the children, brothers and sisters who did not reach 18 years the children, children having disability are more senior than 18 years which disability are established before achievement of 18 years, become disabled people before achievement of this age, pupils of orphanages, and getting education in educational institutions of professional education, secondary vocational and higher education, the specified educational institutions, average special and higher educational institutions - to the termination of these institutions, but no more, than before achievement of age of 23 years;
grandfathers and grandmas, if there are no persons who under the law shall contain them.
Person interested in provision of the status of the martyr or the martyr's family to persons specified in article 1 of this Law addresses to the relevant state bodies.
The matter can be considered also according to the petition of state body or relevant military unit.
The relevant state body, having immediately accepted addresses and petitions, no later than one month shall issue the document on the status of the martyr or the martyr's family according to this Law.
