The government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation which are hereinafter referred to as with the Parties
based on the Agreement on single customs and tariff regulation of January 25, 2008,
for the purpose of assistance to deepening of economic integration and implementation of fair competition,
being guided by the universally recognized norms and rules of international trade,
agreed as follows:
From the date of provision of the Commission of custom union by the Parties (further - the Commission) powers on maintaining the Common customs tariff tariff preferences when importing to customs areas of the states of the Parties or single customs area of the goods occurring and imported from developing and the least developed countries, are provided only according to the this Protocol.
The list of the developing countries users of system of tariff preferences affirms the Commission.
The countries which are not classified by the World Bank as the countries with high income level are included in this list.
The country which is not classified by the World Bank as the country with high income level can be not included in the specified list or is excluded from it in the following cases:
achievement by the country of the income level determined by the World Bank as high;
the import amount from this country of goods of five biggest groups of the Single commodity nomenclature of foreign economic activity on cost amount in two prior years is equal or exceeds 75 percent of total amount of import of these goods from the countries users of preferential system;
