About some questions of execution of court resolutions on civil cases
For the purpose of uniform understanding and application by courts of the legal acts regulating delay, payment by installments, and also change of method and procedure for execution of court resolutions on civil cases, the plenary session of the Supreme Court of the Republic of Kazakhstan decides:
1. According to Item 3 of article 76 of the Constitution of the Republic of Kazakhstan and Article 21 of the Code of civil procedure of the Republic of Kazakhstan (further - GPK) the court resolutions which took legal effect are obligatory for execution by all state bodies and their officials, physical persons or legal entities which these court resolutions concern.
Court resolutions are subject to execution voluntarily or compulsorily.
Voluntariness of execution of the court ruling means that the debtor before excitement of enforcement proceeding independently provides to the claimant the execution ordered by court resolution (makes payment, transfers thing and so on).
Compulsoriness of execution of the court ruling means that the legal executive according to the Law of the Republic of Kazakhstan "About enforcement proceeding and the status of legal executives" (further - the Law on enforcement proceeding) makes those actions which are necessary for execution of the court ruling contrary to will of the debtor.
