About the government address public assistance

For the purpose of strengthening of the state support of the population I decide:

1. The government address public assistance to the population is provided in type:

1.1. monthly social benefit and (or) lump-sum social benefit for acquisition of food, medicines, clothes, footwear, school supplies and for other needs for ensuring normal life activity, and also on payment (fully or partially) housing and communal services;

1.2. social benefit for payment of technical means of social resettlement.

According to this Decree the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the territory of the Republic of Belarus have the right to the government address public assistance (further - citizens).

2. Determine that:

2.1. the monthly social benefit * is provided to families and the citizens living separately or conducting separate economy (further - families (citizens) provided that their average per capita income determined according to the procedure, established by the Government of the Republic of Belarus (further - the average per capita income), for the objective reasons below the largest size of the budget of the subsistence minimum on average per capita approved by the Government of the Republic of Belarus for two last quarters (further - criterion of needs).

* For the purposes of this Decree the monthly social benefit is understood as the payment to family (citizen) for maintenance of her (his) objectively low income guaranteed by the state at the level of the budget of subsistence minimum on average per capita in case of sales term by family (citizen) of the right according to the legislation of social transfers (pensions, benefits, grants, free providing the first two years of life with food of children).

The size of monthly social benefit for each family member (citizen), including each student (pupil) studying in day form of education irrespective of the place of his study, constitutes positive difference between criterion of needs and the average per capita income of family (citizen);

2.2. the lump-sum social benefit is provided to families (citizens) who appeared in the difficult life situation which is objectively breaking normal life activity * provided that their average per capita income does not exceed 150 percent of criterion of needs.

* For the purposes of this Decree the difficult life situation which is objectively breaking normal life activity of family (citizen) is understood as the circumstances difficult for independent permission (total disability because of disability or achievement of 80-year age by citizens, inability to self-service in connection with disease, and also natural disasters, catastrophic crashes, the fires and other circumstances).

The size of lump-sum social benefit is established in the amount to 500 percent of the budget of the subsistence minimum on average per capita approved by the Government of the Republic of Belarus and existing for date of the address depending on difficult life situation in which there is family (citizen);

2.3. the social benefit for payment of technical means of social resettlement is provided to the children aged up to 18 years who are not recognized as disabled people, but the person in need on medical indications in such means and also disabled people of III group, except persons whose disability was caused by illegal actions, because of alcoholic, drug, toxic intoxication, mutilation, irrespective of the size of the average per capita income of family (citizen) in the amount of the cost of technical means of social resettlement.

3. The government address public assistance in type of monthly social benefit is not provided to the citizens living separately or conducting separate economy or in family composition:

3.1. being military personnel of compulsory military service, cadets studying in day form of education, the organizations of education performing training on specialties (the directions of specialties, specializations) for Armed Forces of the Republic of Belarus, other troops and military forming of the Republic of Belarus, law-enforcement bodies of the Republic of Belarus, bodies of financial investigations of the State Control Committee, bodies and divisions on emergency situations of the Republic of Belarus;

3.2. serving sentence in places of detention or being on forced treatment;

3.3. refunding expenses on content of the children who are on the state providing;

3.4. working at conditions of part-time if such operating mode is set at their request, except as specified, when the employer establish part-time according to the legislation;

3.5. being on the state providing in the state stationary organizations of social servicing, child care residential care facilities (children's homes, social and pedagogical organizations, schools - nursing homes for orphan children and children without parental support, auxiliary boarding schools, special general education schools - the nursing homes, special teaching and educational facilities, special medical educational facilities and other organizations providing conditions for accommodation (content) of children), orphanages of family type, foster (tutorial) homes or being on the state providing in public institutions of professional, secondary vocational and higher education during training in these organizations in day form of education, including at faculties of pre-university preparation and preparatory departments;

3.6. being idle able-bodied persons which are not registered in the procedure established by the legislation as the unemployed (except persons performing child care aged up to 3 years, the handicapped child aged up to 18 years, the child aged up to 18 years infected with human immunodeficiency virus, the disabled person of the I group or person who reached 80-year age and also persons who got the general secondary education in year of its obtaining (for the period till September 1), and persons directed by committee on work, employment and social protection of the Minsk city executive committee, management (department) of work, employment and social protection of district (city) executive committee to professional training, retraining and advanced training);

3.7. being idle able-bodied persons registered in the procedure established by the legislation as jobless less than three months for date of the address. The specified term is not applied to persons registered as the unemployed within a month after:

dismissals from work (service) in connection with liquidation of the organization, the termination of activities of the individual entrepreneur, reducing number or staff of workers;

achievements of 3 years by the child of age, the handicapped child and the child infected with human immunodeficiency virus - age of 18 years;

dismissals from military service;

the expirations of the employment contract signed for the period of accomplishment of seasonal works or certain work;
