About some questions of acquisition of rights of property rights to results of scientific and technical activities and the order these rights

For the purpose of enhancement of procedure for use of results of scientific and technical activities, the order property rights on these results:

1. Determine that acquisition of rights of property rights to the results of scientific and technical activities created fully or partially at the expense of means republican and (or) local budgets, including means of the state trust budget funds and also at the expense of means of state non-budgetary funds (further - results of the specifications and technical documentation), transfer of property rights on these results and provision of the right of their use are performed according to the procedure, determined by this Decree and other legal acts.

Material objects (samples of new materials, devices, installations, products of different function and others) in which the results of the specifications and technical documentation created in the course of execution of contracts for accomplishment of research, developmental and technological works are expressed can be acquired and be transferred along with acquisition of rights and transfer of property rights to these results.

2. For the purposes of this Decree the following terms are used:

2.1. results of the specifications and technical documentation - the intellectual property items created when implementing scientific and technical activities and also the scientific and technical information fixed on the material carrier with the details allowing to identify it;

2.2. the state customer - the organization which is the manager of means republican and (or) local budgets, including means of the state trust budget funds, and also means of the state non-budgetary funds (further - public funds) provided for financing of creation of results of the specifications and technical documentation, signing agreements with contractors;
