noting that illegal export, transit and import of cultural values cause damage to cultural property of the people which protection shall be promoted by customs and other competent authorities of the states,

in view of regulations of the Convention of UNESCO on the measures directed to prohibition and the prevention of illegal import, export and transfer of property to cultural values of November 14, 1970

aiming to strengthen fight against illegal transportation of cultural values through frontiers and to strengthen customs cooperation in this area,

agreed as follows:

Article 1

For the purposes of this agreement the following terms are applied:

1. "Customs Services" are meant in Russian by Federatsiigosudarstvenny customs committee of the Russian Federation and in Turkmenistan - the State customs of Turkmenistan.

2. "Cultural values" means values of religious or secular nature which are considered by the Parties as representing value for archeology, including the prehistoric period, history, literature, art and science.

3. "The state of export" means the state - the Russian Federation or Turkmenistan - from which cultural values were exported originally.

4. "Transit State" means the state - the Russian Federation or Turkmenistan - through the territory of which cultural values follow from the state of export to other states.

5. "The state of import" means the state - the Russian Federation or Turkmenistan - into which cultural values were imported.

6. "Illegal transportation of cultural values" means the export, transit and import of such values made in defiance of provisions of this agreement, other international obligations of the Parties and their domestic legislation.
