About social protection of disabled people

This Law determines state policy in the field of social protection of disabled people which purpose is providing to disabled people of opportunities, equal with other citizens, in realization of the civil, economic, political and social rights and freedoms established by the constitution of the state, and also the conventional principles and rules of international law and international treaties of the state.

The state performs the measures directed to public health care, disability prevention and creates conditions for integration of disabled people into society.

Chapter 1. General provisions

Article 1. Concept "disabled person", bases of determination of group of disability

1. The disabled person - person having the violation of health with permanent disorder of functions of organism caused by diseases, injuries, their effects, defects which lead to restriction of life activity and need of its social protection.

2. Life activity restriction - complete or partial loss by person of capability or opportunity to perform self-service, to independently move, be guided, communicate, to control the behavior, to study and be engaged in labor activity.

3. Depending on extent of disorder of functions of organism and restriction of life activity to persons recognized as disabled people the group of disability and extent of loss of capability to labor activity are established.

4. Recognition of person by the disabled person is performed in accordance with the established procedure by the state bodies authorized on that. The procedure and conditions of recognition of person by the disabled person are established by the government.

Article 2. Concept of social protection of disabled people

Social protection of disabled people - system of the economic, legal measures and measures of social support providing to disabled people of condition for overcoming, substitution (compensation) of restrictions of life activity and opportunities of participation in life of society, equal with other citizens, directed to creation to them guaranteed by the state.

Social support of disabled people - the system of measures providing social guarantees to disabled people, established by the laws and other regulatory legal acts, except for provision of pensions.

Article 3. Principles of state policy of creation of equal opportunities and elimination of social barriers to disabled people

1. Disabled people have the right to live in the traditional environment and message, with necessary support, regular conduct of life.

2. Disabled people have the right to take part in decision making at all levels, including those questions which have for them as for physically handicapped persons special value.

3. Disabled people, whenever possible, have the right to receive necessary assistance within regular education systems, health cares, social services, and also, if necessary, to use services of special services.

4. Disabled people have the right to take active part generally social and economic development of society, and their requirements shall be considered in national development plans.

5. The state takes the responsibility for creation of equal opportunities concerning disabled people including:

- prohibition of discrimination on the principle of disability;

- regular collection of statistical data about living conditions of disabled people, about different groups of disabled people, creation of databank about disabled people;

- development and support of national programs taking into account the reasons, types and scales of disability, development of special services and relief measures to disabled people and their families;

- involvement of the organizations (associations) of disabled people to participation in development of the programs concerning economic and social position of disabled people;

- cooperation with research institutions and exchange of results of scientific research, distribution of information and knowledge of the questions concerning disabled people among state bodies and the public.

Article 4. Competence of state bodies in social protection of disabled people

In the field of social protection of disabled people treat maintaining state bodies:

- determination of state policy concerning disabled people;

- development and implementation of measures for disability prevention, including on the basis of reducing disability owing to poisonings, the road accidents, occupational diseases;
