About some questions of establishment of correspondence relations by Central Securities Depository in the Republic of Belarus

Based on the paragraph of third subitem 1.2 of Item 1 of the Presidential decree of the Republic of Belarus of June 25, 2009 No. 331 "About entering of amendments and changes into the Presidential decree of the Republic of Belarus of April 28, 2006 No. 277", Item 10 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585 "Questions of the Ministry of Finance of the Republic of Belarus", the Ministry of Finance of the Republic of Belarus DECIDES:

1. Determine that:

1.1. the Central Securities Depository in the Republic of Belarus (further - the central depositary) has the right to establish correspondence relations with the securities depository created according to the legislation of foreign state (further nonresident depositary) conforming to the following requirements:

implementation of depository activity by nonresident depositary at least 3 years;

availability at nonresident depositary of special permission (license) for the right of implementation of depository activity which effective period expires not earlier than one year from the date of the conclusion of the service provision agreement on accounting of the rights to securities which releases are stored in Central Securities Depository in the Republic of Belarus (further - the contract for establishment of correspondence relations) (if the legislation of the state where the nonresident depositary is registered, provides licensing of depository activity);

availability at nonresident depositary of permanent office in the state where the nonresident depositary is registered;
