About approval of the Procedure of social maintenance of foster homes and orphanages of family type

According to resolutions of the Cabinet of Ministers of Ukraine of 26.04.2002 N 565 "About approval of the Regulations on foster home" (with changes), of 26.04.2002 N 564 "About approval of the Regulations on orphanage of family type" (with changes) I ORDER:

1. Approve the Procedure of social maintenance of foster homes and orphanages of family type which is applied.

2. Republican (Autonomous Republic of Crimea), regional, Kiev and Sevastopol city, district, city, district in the cities, to the settlement and rural centers of social services for family, children and youth to provide accomplishment of this Procedure.

3. To the public social service for family, children and youth (Lukyanova N. L.) perform coordination of work concerning implementation of social maintenance of foster homes and orphanages of family type, to provide carrying out annual corresponding monitoring.

4. To the public social service for family, children and youth (Lukyanova N. L.) at the scheduled time to submit this order on state registration according to the Presidential decree of Ukraine of 03.10.92 N 493 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes).

5. Declare invalid the order of the Ministry of Ukraine for family, youth and sport of 31.10.2006 N 3685 "About approval of the Procedure of social maintenance of foster homes and orphanages of family type", registered in the Ministry of Justice of Ukraine 24.11.2006 for N 1232/13106.

6. To impose control over the implementation of the order on the deputy minister Kondratyuk T. V. and director of the Public social service for family, children and youth Lukyanova N. L.

7. This order becomes effective from the date of its official publication.

Procedure of social maintenance of foster homes and orphanages of family type

I. General provisions

1.1. This Procedure is developed according to resolutions of the Cabinet of Ministers of Ukraine of 26.04.2002 N 565 "About approval of the Regulations on foster home" (with changes), of 26.04.2002 N 564 "About approval of the Regulations on orphanage of family type" (with changes), for the purpose of determination of content, tasks, the procedure of implementation of social maintenance.

1.2. Social maintenance of foster homes and orphanages of family type (further - social maintenance) - the work providing implementation by the specialist (or group of specialists) the center of social services for family, children and youth (further - the centers) the actions aimed at providing proper operating conditions of foster home, orphanage of family type, in particular provisions of social services.

II. Subjects and subjects to social maintenance

2.1. The main subject of social maintenance are the centers.

2.2. To the problem resolution of family during implementation of social maintenance specialists from different fields of activity which are employees of services for children, departments of cases of family, youth and sport, health care, education, work and social protection of the population, other companies, organizations, the organizations and so forth can be attracted in their consent (doctors, lawyers, psychologists, etc.).

2.3. For involvement of the specialist the center performing social maintenance addresses with the corresponding petition to the relevant organization.

2.4. 2.5. Specialists of the center can interact with associations of the citizens having work experience in the field of protection of the rights of the child according to prisoners between the center and them agreements on cooperation.

2.6. Subjects to social maintenance are:

adopted children;

children pupils of orphanage of family type;

adoptive parents;

parents tutors;

own children of adoptive parents and parents tutors;

other persons (family members) jointly living with adoptive parents, parents tutors.

III. Purpose and tasks of social maintenance

3.1. The purpose of social maintenance is creation of proper conditions for ensuring individual needs of each adopted child and the child pupil in development and education.

3.2. The main informative components of social maintenance are:

creation and maintenance of positive social and psychological climate in family;

adaptation of the child in new conditions;

maintenance of contacts of the child with his biological relatives;

training of the child for exit from foster home, orphanage of family type, including in independent life.

3.3. Social maintenance is performed through visit of family and carrying out work with the adopted child, the child pupil and adoptive parents, parents tutors, other persons (family members) who jointly live with adoptive parents, parents tutors, by provision of complex of social services, in particular:

3.3.1 legal (provision of consultations concerning application of the current legislation; help in document creation, subjects to social maintenance, necessary for the problem resolution; cooperation with different organizations and specialists for provision of professional legal aid and so forth);

3.3.2 psychological (the help in adaptation of the child to new family and families to the child, creation of positive psychological climate; the help in the prevention of the conflicts between family members; consultation on questions of psychological health and improvement of the relations with surrounding social environment; performing diagnostics directed to studying of social and psychological characteristics of the personality; the organization of the rehabilitation actions directed to overcoming delays, lagging in development, the mental and psychological problems connected with neglect, injuries and diseases, ill treatment or violence which the child to ustraivaniye in foster home underwent, orphanage of family type and so forth);

3.3.4 social and economic (the help in attraction of material resources for the needs for treatment, improvement and so forth; assistance in permission of household problems, employment of adopted children, children pupils after achievement by them of age of majority or the end of study and so forth);

3.3.5 social and medical (the help to adoptive parents, parents tutors in permission of questions of preserving, maintenance and health protection of adopted children, children pupils, especially HIV-positive and with functional restrictions; provision of information of rather healthy method of life, prevention of tuberculosis, venereal diseases and HIV/AIDS and so forth);

3.3.6 information (informing on children's educational institutions, circles, sports schools and occupations, on activities of nurseries, youth public organizations, hikes, cultural actions and the help in their use for benefit of the child; provision of information on services which can be received in the centers and so forth).

3.4. Forms and methods of implementation of social maintenance are determined by the specialist of the center individually concerning each foster home, orphanage of family type taking into account their requirements.

IV. Beginning of social maintenance

4.1. Social maintenance begins after decision making district, district in Kiev and Sevastopol public administration, executive committee of city council (the cities of republican value of the Autonomous Republic of Crimea and the cities of regional value) about creation of foster home, orphanage of family type and transfer of children to them.
