Some questions of application of the legislation on work by the physical person using wage labor

The Cabinet of Ministers of Ukraine decides:

1. Determine that the form of the employment contract between the worker and the physical person who uses wage labor (further - physical person) affirms the Ministry of Labour and Social Policy.

2. For registration of the employment contract the physical person submits to week time from the moment of the actual admission of the worker to work to public service of employment at the place of residence the employment contract signed by the parties in triplicate, the certificate on state registration of physical litsapredprinimatel, the certificate of the relevant state tax authorities of assignment of identification number, the copy of such reference issued to the worker its service record and are shown by the passport. The signature makes sure of the employment contract of the worker which was not present during its registration notarially.

3. The responsible person of public service of employment registers in day of submission by physical person of documents, stipulated in Item 2 these resolutions, the employment contract in the book of registration of employment contracts which form affirms the Ministry of Labour and Social Policy then two copies of such contract with mark on registration return to physical person.

The physical person shall hand on receipt to the worker one copy of the registered employment contract within three working days from the date of its receipt about what the corresponding entry in the book of registration is made, and also to return the service record with record about acceptance for work.

4. In case of termination of the employment contract at the initiative of physical person in the cases determined by the Labor code of Ukraine (322-08), such person shall report in writing about the intention to the worker and to carry out stipulated by the legislation calculation to certain terms.

5. Removal of employment by public service from registration of the employment contract in cases, stipulated in Item 4 these resolutions is carried out on condition of representation by physical person:
