The customs union agreement about quarantine of plants

The governments of state members of custom union within Eurasian economic community (further - custom union) which are hereinafter referred to as with the Parties for the purpose of forming of custom union, based on the Agreement on carrying out coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008, recognizing feasibility of carrying out coordinated policy in scope of quarantine phytosanitary requirements and measures, in view of rules and the principles of the International convention on quarantine and protection of plants (Rome, 1951, in edition of 1997) (further - the Convention), Agreements on technical barriers in trade and Agreements on application of the sanitary and phytosanitary measures of the World Trade Organization taken following the results of the Uruguayan round of multilateral trade negotiations on April 15, 1994 to Marrakech for the purpose of ensuring protection of customs area of custom union from delivery and distribution of quarantine objects and decrease in the losses caused by them, and also removal of obstacles in international trade in quarantine products, agreed as follows:

Article 1

For the purposes of this agreement the following basic concepts are used:

"quarantine objects (quarantine harmful organisms)" - the harmful organisms which are absent or restrictedly extended in the territories of the states of the Parties and brought in national Lists of quarantine objects;

"phytosanitary quarantine control (supervision)" - the activities of the national authorities of the states of the Parties given authority in the field of quarantine of plants directed to identification of quarantine objects, establishment of quarantine phytosanitary condition of quarantine products and accomplishment of the international obligations of the states of the Parties and the legislation of the state in the field of quarantine of plants;
