Methodical instructions about expertize of industrial safety

1. SCOPE

1.1 Methodical instructions about expertize of industrial safety (further - Methodical instructions) establish procedure for expertize of industrial safety (further - examination), technique of inspection and assessment of technical condition of hazardous production facilities and is developed according to the Law of the Republic of Kazakhstan "About industrial safety on hazardous production facilities" (1).

1.2 Methodical instructions extend to conducting examination:

1) the project documentation on construction, expansion, reconstruction, modernization, preservation and liquidation of hazardous production facility;

2) conditions of buildings and constructions on hazardous production facilities;

3) technologies, technical devices, the materials applied on hazardous production facilities;

4) declarations of industrial safety;

5) the productions manufacturing technical devices on hazardous production facilities.

1.3 The main objectives of conducting examination are:

- control of technical condition of object for the purpose of establishment of compliance of object to requirements of technical documentation and determination of its working capacity at the moment;

- search of places of defects and damages, determination of causes of defect and refusals with the recommendation of methods and reconditioners of object;

- forecasting of technical condition of object for the forthcoming period of operation with the set probability of no-failure operation or determination of its residual resource of no-failure operation.

3. TERMS AND DETERMINATIONS

In these Methodical instructions the following terms and determinations are applied:

Declaration of industrial safety of hazardous production facility: the document in which results of comprehensive risk assessment of accident, the analysis of sufficiency of the taken measures for the prevention of accidents and for ensuring readiness of the organization for operation of hazardous production facility according to requirements of regulations and rules of industrial safety, to localization and recovery from the accident on hazardous production facility are provided.

Industrial safety: condition of security of physical persons and legal entities, the environment from accidents on hazardous production facilities and effects of the specified accidents;

Authorized body the state body exercising state regulation and control in the field of industrial safety.

Expert opinion: the document containing valid conclusions about compliance or discrepancy of object of examination to requirements of industrial safety.

Expert: the specialist performing expertize of industrial safety.

Examination of industrial safety: assessment of conformity (or discrepancies) object of examination to requirements of industrial safety and the existing specifications and technical documentation imposed to it of which the expert opinion is result.

Expert organization: the organization certified by authorized body in the field of industrial safety on expertize of industrial safety.

4. PROCEDURE FOR CONDUCTING EXAMINATION

4.1 Examination of the project documentation on construction, expansion, reconstruction, modernization, preservation and liquidation of hazardous production facility; conditions of buildings and constructions on hazardous production facilities; technologies, technical devices, the materials applied on hazardous production facilities; productions, the making technical devices for hazardous production facilities (further - the company) it is carried out by the organization certified by authorized body on expertize of industrial safety (further - the expert organization).

4.2 All process of conducting examination is documented. Process of conducting examination consists of the following stages:

1) preliminary negotiations;

2) the conclusion of the agreement of the determining condition of conducting examination;

3) examination process;

4) issue of the expert opinion.

4.3 In case of the appeal of the company for question of expertize of industrial safety the expert organization holds preliminary negotiations with it.

4.4 Preliminary negotiations are held for informing specialists of the company on procedure for conducting examination and discussion of the questions concerning conducting examination including:

1) content and course of examination;

2) preparation for conducting examination;

3) creation of the schedule;

4) conducting examination.

4.5 Expertize is carried out based on the agreement according to approved by the expert organization and the company.

In the agreement:

- contracting parties are determined;

- objects of examination are determined;

- the list of information necessary for conducting examination of object according to the existing regulating technical documentation is provided;

- the consent of divisions of the company to fulfill requirements, on conducting examination, and payment of expenses on conducting examination irrespective of its result proves to be true;

- terms of conducting examination are determined.

4.6 The term of conducting examination is determined by complexity of object of examination, but no more than three months from the moment of receipt of set of required materials and documents, and accomplishment of contractual conditions of conducting examination.

4.7 The expert organization starts conducting examination after receipt of set of required materials and documents in full.

4.8 Process of examination includes:

- matching of materials and documentation necessary for conducting examination of object;

- conducting examination.

4.9 For conducting examination the division of the company represents:

- data on the company and object of examination;

- project, design, operational, repair documentation, the declaration of industrial safety of hazardous production facility, the passport of technical devices, production schedules and other documentation having information necessary for identification (depending on object of examination);

- acts of testing, certificates, on components, strength calculations;

- equipment samples, production facilities for check of compliance to requirements of industrial safety.

In case of discrepancy of the provided materials and documentation to the established requirements the expert organization notifies the company on terms of representation of materials and documentation in full. Direction term the expert organization of the notification no more than 7 days from the date of receipt of materials.

4.10 For conducting examination one is appointed or, group of skilled experts depending on examination amount.

In case of conducting examination by the group of experts the leading expert leading work of the group of experts is appointed.

4.11 Conducting examination consists in establishment of completeness, reliability and correctness of the provided information, compliance to its regulations, requirements of industrial safety.

In necessary cases forces of the expert organization carry out testing by the techniques and programs approved with division of the company.

If necessary the expert organization carries out expertize with departure on the object which is subject to examination.

4.12 Examination on site consists of the following stages:

- prolog;

- directly examination on site;

- final part.

4.13 Prolog tasks:

- receive explanations on the purpose of examination and task of the expert (group of experts);

- report that any data and information transferred in the course of examination shall be considered by the staff of the expert organization as confidential, taking into account requirements of the legislation of the Republic of Kazakhstan;

- discuss and determine amount of works;

- determine accompanying persons for experts;

- receive explanations value of final part;

- approve the schedule of conducting examination together with the expert organization.

4.14 In case of examination on object carry out complex inspection:

- suitability of rooms and the instrument equipment, condition of test means and devices from the point of view of servicing;

- availability of reliable systems of marking and identification;

- availability of the relevant normative and technical, methodical documents, and their execution;

- observance of requirements to content and execution of reporting documents;

- efficiency of production supervision.

The expert group can receive on demand in the order all necessary analysis results, documents, calculations, protocols and reports in writing.

4.15 Final part of examination on site.

Each expert gives the reference, generalizes results and offers them for discussion with representatives of the company. In final part actions are approved (Appendix 1), examinations, necessary for further completion, the schedule of their realization. The mentioned actions are reflected in the protocol. Examination comes to the end only after realization of these actions.

Actions are determined in the course of examination and represent fulfillment of requirements which the division of the company carries out for certain term to give the chance to complete examination process.

The actions which are subject to accomplishment are formulated by the leading expert by consideration of the expert opinion. Check of accomplishment of actions is performed by the expert organization.

4.16 Results of the works which are carried out by experts are drawn up by each member of expert group in report type.

In case of work of the group of experts all reports are generalized in the draft of the expert opinion constituted by the leading expert according to reports of members of expert group. The draft of the expert opinion forms the basis for consultations and decision making about issue of the positive or negative conclusion.

The draft copy of the expert opinion is sent the company. Claims to the draft of the conclusion go to the company to the expert organization in writing and not later than in 10 days after receipt of the project.

4.17 The decision on issue of the positive or negative expert opinion is accepted based on consideration and the analysis of the results received in case of examination, check of condition of object by results of carrying out testing.

4.18 In case of positive experimental testimony in it objects to which its action with conditions or without them extends are listed.

4.19 In case of the negative conclusion on the object of examination which is in operation, the expert organization shall inform authorized body or its territorial subdivision with indication of discrepancy to requirements of rules of industrial safety with reference to Articles of regulations and rules, for decision making on further operation of production facility.

4.20 Valid conclusions are represented to division of the company:

- about need of completion of the provided materials according to the notes and offers stated in the closing statement of the expert (leading expert);

- about inadmissibility of operation of object of examination in view of neediness of observance of requirements of industrial safety;

- the company has the right to provide materials for repeated examination on condition of elimination of the notes revealed during examination. The procedure for conducting examination in this case is determined by the supplementary agreement.

5. REQUIREMENTS TO EXECUTION OF THE EXPERT OPINION

5.1 The expert opinion can is disputed by the company judicially.

5.2 The expert opinion shall contain:

- name of the expert opinion;

- the prolog including the basis for conducting examination, data on the expert organization, the information about experts and availability of the certificate on the right of expertize of industrial safety;

- the list of objects of examination to which action of the expert opinion extends;

- data on the company;

- examination purpose;

- data on the documents considered in the course of examination (project, design, operational, repair, declarations of industrial safety), technical devices and others with indication of amount of the materials having the code, number, the brand or other indication necessary for identification (depending on object of examination);

- short characteristic and purpose of object of examination;

- results of the carried-out expertize;

- final part with valid conclusions, recommendations about technical solutions and actions;

- the appendices containing list of the regulating technical and methodical documentation used in case of examination, acts of testing.

- the approved and approved organizational and technical actions for reduction of object of examination according to requirements of the Law (1).

5.3 The expert opinion shall be signed by the head of the expert organization, is certified by seal of the expert organization, stitched with indication of the number of the sewed pages.

6. EXAMINATION OF THE DECLARATION OF INDUSTRIAL SAFETY

6.1 General provisions

6.1.1 Expertize of the declaration of industrial safety is carried out for the purpose of establishment:

- compliance of the completeness and accuracy of the information provided to declarations, to requirements of industrial safety;

- justification of analysis results of risk of the accidents on hazardous production facility stated in the declaration;

- sufficiency of the developed and/or realized measures for providing requirements of industrial safety.
