About application of the legislation by courts by hearing of cases about paternity proof

In our independent state much attention is paid to question of maternity welfare and the childhood, education of younger generation, and also measures for physical, spiritual development of younger generation are taken.

The constitution of the Republic of Uzbekistan guarantees strengthening of family, protection of motherhood and the childhood from the state.

Courts by consideration of civil cases, on disputes, following from the matrimonial relations, generally correctly apply the laws. At the same time in the analysis of civil cases on questions of paternity proof and penalties of the alimony some mistakes and shortcomings are sometimes made.

For the purpose of prevention of the misunderstanding arising in practice by hearing of cases and for ensuring the correct application of the laws in case of paternity proof based on article 17 of the Law "About Courts" Plenum of the Supreme Court of the Republic of Uzbekistan decides:

1. Courts by consideration of disputes on paternity proof, proceeding from circumstances of cases, shall follow strictly the normative requirements determined in the Constitution of the Republic of Uzbekistan about obligations of parents to contain and raise the children to their age of majority, about maternity welfare and the childhood by the state.
