Methodology of conducting anti-corruption examination of drafts of regulatory legal acts

General part

1. This Methodology determines the main stages of conducting anti-corruption examination of drafts of regulatory legal acts (further - acts), the major corruptogenic factors, their signs and recommendations concerning their elimination.

2. In this Methodology terms are used in the following value:

ministerial procedure - the operations procedure of physical persons and legal entities established in the act directed to realization of their rights and accomplishment of obligations or determination of powers of state body its official and the official;

anti-corruption examination of drafts of acts - verification of drafts of acts regarding availability in them of provisions which promote or can promote making of corruption offenses, for the purpose of prevention of emergence of premises for making of such offenses and development of recommendations concerning their elimination;

discretion - set of the rights and obligations of state bodies, their official and officials who give the chance at discretion to determine fully or partially contents of the decision or to choose one of several options of decision making provided by the draft of the act;
