Technical regulation "Safety of construction materials, products and designs

Article 1. Scope of this Technical regulation

1. This Technical regulation "Safety of Construction Materials, Products and Designs" (further - the Technical regulation) is applied for the purpose of protection of life and human health, plant and animal life, environmental protection, the prevention of the actions misleading consumers concerning the safety arising in design process, production (production), transportation, storage, realization, use and utilization (lifecycle stage) of construction materials, products and designs.

2. This Technical regulation establishes:

1) objects of technical regulation and their identification;

2) minimum necessary safety requirements to characteristics (properties) of construction materials, products and designs at all stages of their lifecycle;

3) requirements to information for the prevention of the actions misleading consumers;

4) forms of assessment of conformity of construction materials, products and designs to the requirements established in this Technical regulation.

3. Objects of technical regulation in this Technical regulation are:

1) the construction materials, products and designs, their characteristics determining safety;

2) design processes, production (production), transportation, storage, realization, use and utilization of construction materials, products and designs.

4. Identification of the construction materials, products and designs falling within coverage of this Technical regulation is established by use of codes of the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (CN FEA EEU) and the codes corresponding to them on the qualifier of products (OKP).

5. This Technical regulation is applied together with other technical regulations establishing safety requirements to characteristics (properties) of construction materials, products and designs or at stages of their lifecycle.

6. Requirements of other technical regulations cannot cancel or reduce the requirements established by this Technical regulation.

7. This Technical regulation does not extend to the construction materials, products and designs which were in the use and reusable in construction.

Article 2. Basic concepts

For the purposes of this Technical regulation the basic concepts established in the Law of the Kyrgyz Republic "About bases of technical regulation in the Kyrgyz Republic" are used. Along with them the following basic concepts are used:

safety of construction materials, products and designs at all stages of their lifecycle - lack of the unacceptable risk connected with damnification of life and to human health, their property, the environment, including animals and plants;

the regulating documents interconnected with the technical regulation - the regulating documents realizing safety requirements of this Technical regulation;

lifecycle of construction materials, products and designs - design processes, production (production), transportation, storage, realization, use and utilization of construction materials, products and designs;

the applicant - the producer (manufacturer) of construction materials, products and designs registered according to the legislation of the Kyrgyz Republic in its territory as the legal entity or the individual entrepreneur, the seller or person performing functions of the foreign producer (manufacturer) based on the contract with it regarding ensuring compliance of delivered goods to requirements of this Technical regulation;

the building - land and underground construction construction with rooms for accommodation and (or) activities of people, placement of productions, storage of products or content of animals;

identification of products - establishment of compliance of specific products to sample and (or) its description;

the producer (manufacturer) - the legal entity or the individual entrepreneur who make construction materials, products and designs according to technical and technological documentation, officially applying on them (container, packaging) distinctive designations, thereby recognizing the right and responsibility for safety of products;

the importer - the legal entity or the individual entrepreneur who import construction materials, products and designs from other countries, thereby undertaking functions and responsibility for their safety instead of the foreign manufacturer according to the legislation of the Kyrgyz Republic;

utilization - the activities connected with accomplishment of complex of organizational and technological measures for destruction and burial of the dangerous and not used building wastes or neutralization of waste for the purpose of receipt of secondary raw materials and useful products;

minimum necessary requirements - the safety requirements based on damnification risk assessment sufficient for protection of life and human health, environmental protection, animals or plants, the prevention of the actions misleading consumers concerning safety of construction materials, products and designs;

new products - the products for the first time made and (or) imported on the territory of the Kyrgyz Republic on which there are no technical requirements approved in accordance with the established procedure, including obligatory;

safety - acceptance of complex of technical and organizational measures for exception of the unacceptable risk connected with possibility of causing damage of life or to human health, its property and (or) the environment, including plant and animal life;

the address of construction materials, products and designs in the market - all stages of lifecycle of construction materials, products and designs, except designing and production (production);

danger object - construction materials, products and designs and production processes (production), transportation, storage, realization, use and utilization interconnected with them which can make negative impact on people, their property, the environment, animals and plants;

the seller - the legal entity or the individual entrepreneur who, without being manufacturers, authorized representatives or importers, sell construction materials, products and designs and bear responsibility for their safety according to the legislation of the Kyrgyz Republic;

construction - the single result of construction activities intended for implementation of certain consumer functions;

building construction - the part of the building or construction which is carrying out the bearing, protecting and (or) esthetic functions;

construction product - the product intended for application as element of building constructions of buildings and constructions;

construction material - the material intended for production of construction products and structures of buildings and constructions;

the subject of danger - people, animals and plants, the environment, property which danger object influences;

the authorized representative - the legal entity or the individual entrepreneur who signed the contract with the manufacturer for the right to do business by construction materials, products and designs and bearing responsibility for their safety from his name according to the legislation of the Kyrgyz Republic.
