Article 1. The guaranteed minimum size of the salary in the real sector

1. Since February 1, 2010 the guaranteed minimum size of the salary in the real sector (at the self-supporting companies, the organizations, organizations irrespective of the type of property and form of business which are hereinafter referred to as by the companies) will constitute leu 6,51 in hour, or 1100 lei the month estimated from the average duration of working hours of 169 hours in month.

2. The companies are granted the right to enter the guaranteed minimum size gradually, depending on financial opportunities, but no later than May 1, 2010.

3. In case the companies apply tariff wage system, the guaranteed minimum size of the salary in the real sector will form basis for negotiations and establishment in collective agreements of industry level or in collective employment contracts of the tariff charge for the I qualification category, and in case of application of non-tariff wage system - the minimum limit of the salary for differentiation of the pay level of work on employee categories.

Article 2. Special conditions of use of the guaranteed minimum size of the salary in the real sector for employees of the companies of agricultural industry and forestry

1. In departure from Article 1 provisions the guaranteed minimum wage, before the following change, will be applied to the main personnel of the companies of agricultural industry and forestry in the amount of 90% of the nominal size (leu 5,86 in hour, or 900 lei a month), and for support personnel of these industries the base pay will constitute at least 3,55 of leu in hour, or at least 600 lei a month, estimated from the average duration of working hours of 169 hours in month.
