1) to Approve the Procedure for introduction of single accounting, registration of crimes and persons them made.

2) to the Ministry of Internal Affairs of the Republic of Tajikistan together with the relevant ministries and departments to take necessary measures for realization of the specified Procedure.

This Procedure to put 3) in action since January 1, 2010.

Procedure for introduction of single accounting, registration of crimes and persons them made

I. General provisions

1. The procedure for introduction of single accounting, registration of crimes and persons made (further - the Procedure) determines them:

- system and technique of single accounting and the statistical reporting for all bodies performing inquiry, pretrial investigation and judicial proceedings on criminal cases;

- accounting treatment for crimes, persons of their made, criminal cases of other objects of accounting (further - the crime reporting).

The single crime reporting consists in:

- registration of objects of accounting;

- primary accounting of objects of accounting;

- introduction in the statistical reporting of objects of accounting.

The procedure is based on the following principles:

- legality, objectivity, reliability and comparability of information;

- availability and openness of information in the limits set by the legislation;

- obligation and uniformity of registration and accounting of offenses.

The main objectives of the Procedure are collection, processing, generalization, accumulating, storage and protection of data on offenses, and also their provision to law enforcement agencies of the Republic of Tajikistan and the State Parties of the Commonwealth of Independent States.

This Procedure is based on the Constitution of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan and the international legal acts which are acknowledged the Republic of Tajikistan.

2. In this Procedure the following basic concepts applied in the part concerning the crime reporting are used:

a) Registration - assignment of registration number to subjects to registration and their statement on accounting.

b) Accounting - fixation in accounting documents body of inquiry, the investigator, the investigator, the prosecutor, the judge of data on objects of accounting with later the blowing inclusion by information centers of the Ministry of Internal Affairs, Department of Internal Affairs of areas and the city of Dushanbe, the Main Military Procuracy in the statistical reporting of data on the objects reflected in accounting documents.

e) Separate accounting - fixation in accounting documents body of inquiry, the investigator, the investigator, the prosecutor, the judge of data on acts with essential elements of offense on which persons which made them according to the existing penal legislation of the Republic of Tajikistan are not subjects of crimes, and also the information about specified persons.
