About approval of Regulations of free issue of special clothes, special footwear and other individual protection equipment to employees of the subways
According to the Law of Ukraine "About labor protection" I ORDER:
1. Approve Norma of free issue of special clothes, special footwear and other individual protection equipment to employees of the subways (further - Regulations) (are applied).
2. With the introduction of the order in force to consider not applied in the territory of Ukraine "Standard industry regulations of free issue of special clothes, special footwear and other individual protection equipment to the workers and employees occupied on operation of the subway" approved by the resolution of the State committee of the USSR on work and social problems and Presidium of the All-Union Central Council of Trade Unions of 20.02.80 N 43/P-2, and "The industry regulations of free issue of overalls, special footwear and other individual protection equipment to the workers occupied on operation of the subways", approved by the order MShS USSR of 18.09.90 of N 25-Ts.
3. The order becomes effective since July 1, 2010.
4. To the manager of the sector of the organization of the state supervision of industrial safety and labor protection in mechanical engineering, on transport and in communication Litvinova V. V. in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.
5. To the head of department of normative and legal and legal providing Prokhorov V. V. in accordance with the established procedure to enter the order in the State register of regulatory legal acts concerning labor protection and to post this order on the website of Gosgorpromnadzor.
6. To the assistant department head of personnel, clerical work and special work Kravtsu V. Yu. provide publication of the order in mass media.

1. Regulations of free issue of special clothes, special footwear and other individual protection equipment to employees of the subways (further - Regulations) are developed according to the Law of Ukraine "About labor protection".
2. Regulations extend to the companies and the organizations irrespective of patterns of ownership which perform operation, repair and servicing of objects of the subways.
3. Regulations are developed for professions of employees of the subways according to the Qualifier of professions approved by the order of the State committee of Ukraine concerning technical regulation and consumer policy of 26.12.2005 N 375.
4. Regulations determine types and terms of carrying (use) of overalls, special footwear and other individual protection equipment (далееСИЗ), the subways necessary for workers for production process accomplishment. Classification of the SIZ protective properties depending on dangerous and harmful production factors is applied according to requirements of GOST 12.4.011-89 "SSBT. Remedies of working. General requirements and classification". Designation of the SIZ protective properties is performed according to requirements of GOST 12.4.103-83 "SSBT. The clothes are special protective, individual protection equipment of legs and hands. Classification".
5. Except these Regulations, employees of the organizations and companies of the subways which perform the works relating to other types of economic activity are provided with individual protection equipment according to requirements of the current legislation.
6. Requirements to the level of safety of individual protection equipment, carrying out assessment procedure of compliance to such requirements, establishment of rules of marking of the specified means and their introduction in the address are established by the Technical regulation of individual protection equipment approved by the resolution of the Cabinet of Ministers of Ukraine of 27.08.2008 N 761.
Providing employees of the companies and organizations necessary for labor process of SIZ, and also procedure for their content and storage are performed according to the Regulations on procedure for providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 24.03.2008 of N 53, registered in the Ministry of Justice of Ukraine 21.05.2008 for N 446/15137 (NPAOP 0.00-4.01-08).
7. The individual protection equipment intended for carrying by the worker and/or ensuring its protection against one or several types of danger shall be made of materials which provide optimum thermal condition - air permeability, vapor permeability, heat conductivity - and working ability of the user.
8. In these Regulations it is allowed in some cases, considering features of production, in coordination with the trade-union organization replacement of suit by dressing gown (and vice versa). In case of replacement of one type of special clothes by another their protective properties and working conditions of the user shall not worsen.
