About agreements between executive bodies of the government, local government bodies and business entities on decrease or maintenance of the prices of separate types of the fuels and lubricants realized to agricultural producers

For the purpose of ensuring accomplishment of agricultural works in 2012 and according to the Federal Law "About Protection of the Competition" Government of the Russian Federation decides:

1. Determine that executive bodies of the government of subjects of the Russian Federation and local government bodies have the right to conclude with business entities - producers or suppliers of fuels and lubricants of the agreement on decrease or maintenance of the prices by delivery to agricultural producers of separate types of the fuels and lubricants necessary for carrying out agricultural works.

2. Determine that the agreements signed by the suppliers of fuels and lubricants and agricultural producers included in lists, the stipulated in Item 4 presents of the resolution are recognized admissible in case of observance of the following conditions:

a) subject of agreements is delivery of separate types of fuels and lubricants to agricultural producers at the prices, the stipulated in Item 3 presents of the resolution;

b) agreements do not limit the right of agricultural producers to choose suppliers of fuels and lubricants and do not contain the requirements which are not relating to subject of agreements;

c) use by agricultural producers of the fuels and lubricants acquired at reduced prices only for carrying out agricultural works is provided in agreements;

d) in agreements the assignment is not allowed by agricultural producers of the right of participation in agreements.

3. The agreements provided by Items 1 and 2 of this resolution consist in writing on effective period till December 1, 2012 and implementable to agricultural producers provide the measures undertaken by the parties on decrease or maintenance of the prices of fuels and lubricants.
