About some tax matters of the income of the foreign organizations

For the purpose of creating favorable conditions for attraction of foreign investments to the Republic of Belarus:

1. Determine that the taxation object tax on the income of the foreign organizations which are not performing activities in the Republic of Belarus through permanent mission income gained by these organizations from sources in the Republic of Belarus from provision by them of the credits, loans according to the Presidential decree of the Republic of Belarus of April 18, 2006 No. 252 "About approval of the Regulations on external state loans (credits)" (The national register of legal acts of the Republic of Belarus, 2006, No. 69, 1/7495) is not recognized.

2. In three-months time to provide to Council of Ministers of the Republic of Belarus reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

3. This Decree becomes effective since January 1, 2010, except for Item 2 and the part one of this Item which are becoming effective from the date of signing of this Decree.

Provisions of this Decree regarding the rights and obligations which will arise after entry into force of this Decree are applied to the relations on the tax discharge on the income the foreign organizations which are not performing activities in the Republic of Belarus through permanent mission which arose till January 1, 2010.
