About approval of the List of legal cases and documents which are formed in activities of court, with indication of storage durations

According to the Laws of Ukraine "About judicial system of Ukraine", "About National Archive Fund and archive organizations", the Regulations on Public judicial administration of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of 14.01.2009 of N 14, the Procedure for education and activities of the commissions on conducting examination of value of documents approved by the resolution of the Cabinet of Ministers of Ukraine of 08.08.2007 of N 1004, for the purpose of enhancement of procedure for record keeping and archiving in Appeal and local courts I ORDER:

1. Approve the List of legal cases and documents which are formed in activities of court with indication of storage durations (further - the List) it (is applied).

2. Declare invalid the order of Public judicial administration of Ukraine from 06.01.2006 N 2 "About approval of the List of legal cases which are formed in activities of court, with indication of storage durations of documents", registered in the Ministry of Justice of Ukraine 20.01.2006 for N 51/11925.

3. To chairmen of Appeal Courts of areas, cities of Kiev and Sevastopol, Appeal Court of the Autonomous Republic of Crimea, military apellate court of the Central region and military apellate court of Naval forces of Ukraine (further - Appeal general Courts), appeal administrative and Economic Courts of Appeal (further - Appeal specialized courts), district, district in the cities, city, gorrayonny, district administrative and local economic courts, public vessels of garrisons to observe the requirements established by this Instruction.

4. To management of organizational and analytical work, documentation and control (Brovko T. V.) bring this order to the attention of chiefs of territorial administrations of public judicial administration (further - territorial administrations of GSA), chairmen of Appeal general and Appeal specialized freighters, chairmen of district administrative, local economic courts and public vessels of garrisons.

5. To chiefs of territorial administrations of GSA to inform of this order of employees of territorial administrations of GSA, chairmen district, district in the cities, city, gorrayonny courts, and also workers of the office of these courts.

6. To chairmen of Appeal general and Appeal specialized freighters, district administrative and local economic courts, public vessels of garrisons to inform of this order of workers of the office of court.

7. To provide to management of the organization of work on maintaining legal statistics, clerical work and archive of courts (O.M.'s Kotsyuba) this order on state registration according to the Presidential decree of Ukraine of 03.10.92 N 493 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes).

8. This order becomes effective from the date of its official publication.

9. To impose control over the implementation of this order on the vice-chairman of Kapustinsky VA.

I. General provisions

1. This List is constituted according to the Law of Ukraine "About National Archive Fund and archive organizations", the Procedure for education and activities of the commissions on conducting examination of value of documents approved by the resolution of the Cabinet of Ministers of Ukraine of 08.08.2007 of N 1004, the Code of penal procedure of Ukraine, the Code of civil procedure of Ukraine, the Code of administrative legal proceedings of Ukraine, the Code of Ukraine about administrative offenses, the Economic Procedure Code of Ukraine and other codes of Ukraine.

The list is the main regulatory legal act which establishes storage durations of the legal cases and documents which are formed in activities of court.

2. The list is obligatory and includes legal cases and documents of accounting of legal cases which are formed in activities of Appeal Courts of areas, cities of Kiev and Sevastopol, Appeal Court of the Autonomous Republic of Crimea, military apellate court of the Central region, military apellate court of Naval forces of Ukraine, Appeal administrative courts, Economic Courts of Appeal, local courts (district, district in the cities, city, gorrayonny, public courts of garrisons, district administrative, economic).

3. Storage durations of other documents which display activities of court (the organization of work, legal statistics, personnel work, accounts department, archive, etc.) are determined by the List of standard documents which are formed in activities of public authorities and local self-government, other companies, organizations and organizations, with indication of storage durations of documents, the approved order of the Head archive department under the Cabinet of Ministers of Ukraine of 20.07.98 of N 41, registered in the Ministry of Justice of Ukraine 17.09.98 for N 576/3016 (with changes).

4. The list is used during forming of cases, preparation of nomenclatures and descriptions of cases, development of schemes of classification of documents, conducting examination of value of documents, and also accomplishment of other works connected with determination of storage durations of documents.

5. Legal cases which storage duration is determined by the List "Constantly" belong to National Archive Fund of Ukraine (further - NAF) and are subject to transfer to the Public Records Offices. Documents of permanent storage are transferred to archive storage in the form of originals or copies certified by the responsible person of court (in the absence of originals).
