About approval of the Regulations on interaction between Gosatomregulirovaniya and Gosgorpromnadzor concerning state regulation in the field of labor protection and safety when using nuclear energy

According to the Regulations on the State committee of nuclear regulation of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of 27.12.2006 of N 1830, and the Regulations on the State committee of Ukraine on industrial safety, labor protection and mountain supervision approved by the resolution of the Cabinet of Ministers of Ukraine of 23.11.2006 of N 1640, for the purpose of increase in efficiency of state regulation in the field of labor protection and safety when using nuclear energy we ORDER:

1. Approve Regulations on interaction between Gosatomregulirovaniya and Gosgorpromnadzor concerning state regulation in the field of labor protection and safety when using nuclear energy which is applied.

2. (Prokhorov V. V.) to provide to legal department of Gosatomregulirovaniya (Matveev V. G.) and Management of normative and legal and legal providing Gosgorpromnadzor provision of this order in five-day time on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the First Deputy Chairman Gosatomregulirovaniya Uskov A. G. and First Deputy Chairman of Gosgorpromnadzor Dengin A. P.

Regulations on interaction between Gosatomregulirovaniya and Gosgorpromnadzor concerning state regulation in the field of labor protection and safety when using nuclear energy

I. Principles and main directions of interaction

1.1. This Provision establishes order of interaction between Gosatomregulirovaniya and Gosgorpromnadzor concerning state regulation in the field of labor protection and safety when using nuclear energy, determines the basic principles, the directions and ways of interaction.

1.2. Basic principles of interaction:

joint forming of state policy in the field of labor protection and safety when using nuclear energy, including development of offers concerning security status improvement;

complex use of the resources and means which are available in Gosatomregulirovaniya and Gosgorpromnadzor, their bodies and divisions, for implementation of the state supervision of observance of requirements of the legislation at the companies, in organizations, the organizations using nuclear installations, on subjects of the treatment of radioactive waste (further - Russian joint stock company), sources of ionizing radiation (daleeiiya) and on the mining and overworking uranium objects (further - uranium objects) in operating time in zone of impact of ionizing radiation;

increase in efficiency and effectiveness of implementation of functions of the state supervision, efficiency in case of response to violation of regulatory legal acts on labor protection and on nuclear and radiation safety, conducting investigation and accounting of the accidents and accidents which are subject to special investigation;

increase in efficiency of the state training system and examination concerning labor protection, nuclear and radiation safety;

forming of system single approaches to implementation of functions of state regulation in the field of labor protection and safety when using nuclear energy.

1.3. The main directions of interaction of Gosatomregulirovaniya and Gosgorpromnadzor are:

continuous improvement of regulatory legal acts concerning labor protection regarding protection of personnel and workers against impact of ionizing radiation, including radiation by the technogenic strengthened sources of natural origin;

ensuring the state supervision on security status on nuclear installations, subjects of the address from Russian joint stock company, III, uranium objects;

enhancement and development of system of the organization and carrying out training and examination in case of performance of works with the increased danger;

enhancement of systems of radiation monitoring and radiation control of radiation of personnel, including radiation from the technogenic strengthened sources of natural origin, in particular on objects of fuel and energy complex, the metallurgical, mining, enrichment and overworking objects.

1.4. Gosatomregulirovaniya:

1.4.1. Exercises the state supervision of compliance with law, regulations, rules and standards on nuclear and radiation safety during putting into operation and operation of systems (elements) important for safety of nuclear installations, the objects intended for the address with Russian joint stock company, and uranium objects and also procedure for accounting and registration of certain systems (elements).

1.4.2. Participates (in consent) in work of the commissions on special investigation of accidents which happened on objects and the equipment, supervision of which is exercised by Gosgorpromnadzor.

1.4.3. Performs special investigation of the accidents which happened during putting into operation and operation of the equipment on nuclear installations on which Gosatomregultrovaniya exercises the state supervision.

1.5. Gosgorpromnadzor:

1.5.1. Within the competence exercises the state supervision of observance of regulatory legal acts on industrial safety and labor protection.

1.5.2. Participates in the organization of conducting examination for labor protection of construction projects, means of production, and also expert inspection of the corresponding equipment.

1.5.3. Issues permissions to performance of works of the increased danger and to operation of the corresponding equipment.

1.5.4. Participates in work of the commission on special investigation of accidents which happened in case of operation of the equipment on nuclear installations and III.

1.5.5. Receives from the companies having nuclear installations, acts of investigation of accidents, accidents and occupational diseases.

1.6. Gosatomregulirovaniya and Gosgorpromnadzor for the purpose of differentiation of powers and avoidance of duplication:

approve lists of the constructions, the equipment, equipment and pipelines which are subject to registration in relevant organs of supervision;

mutually recognize the documents of allowing nature issued in accordance with the established procedure.

II. Ways of interaction

2.1. Gosatomregulirovaniya and Gosgorpromnadzor interact in certain directions according to the Section I of this provision by realization of the following events:

2.1.1. Forming of single system approaches to implementation of functions of the state supervision and interaction in case of response to violation of safety requirements.

2.1.2. Coordination and interaction during inspection activities:

concerning implementation of the state supervision;

informing on results of checks;

involvement of inspectors of the parties to participation in checks;

implementation of joint checks;

development of general methodology of conducting checks.

2.1.3. Joint preparation of offers on forming and ensuring realization of state policy concerning labor protection and safety when using nuclear energy.

2.1.4. Increases in efficiency of the organization and carrying out special training and examination in case of performance of works of the increased danger according to Standard regulations on procedure for carrying out training and examination concerning labor protection and the List of works with the increased danger, approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 of N 15, registered in Ministry of Justice 15.02.2005 for N 231/10511 (with changes).

2.1.5. Joint activities in case of attraction of the international technical assistance (training and advanced training of the state inspectors, implementation of radiation monitoring, increase in safety at subjects to use of III, the address with Russian joint stock company, uranium objects and so forth).

2.1.6. The organizations of interaction between Gosatomregulirovaniya and Gosgorpromnadzor at the level of their territorial authorities.

2.2. Gosatomregulirovaniya and Gosgorpromnadzor use information of the State register of sources of ionizing radiation in accordance with the established procedure.

2.3. Gosatomregulirovaniya and Gosgorpromnadzor exchange drafts of plans of supervising activities at the territorial level and consider them in case of plan development of supervising activities the current years.

2.4. Gosatomregulirovaniya and Gosgorpromnadzor exercise supervision:

as separately (independently), and jointly by mutual consent (in the form of conducting joint checks);

in case of requirement involve in conducting checks of subjects of activities in the field of use of nuclear energy of the state inspectors of each other.

2.5. Gosatomregulirovaniya and Gosgorpromnadzor in case of requirement hold joint sittings of boards, interdepartmental meetings, seminars, create working groups for operational permission of questions of labor protection, industrial safety, radiation safety and radiation protection.

2.6. In cases of accidents at the companies, in organizations, the organizations using nuclear installations on subjects of the address from Russian joint stock company, III and on uranium objects of Gosatomregulirovaniya and Gosgorpromnadzor mutually inform each other on these cases, about the executed measures concerning reaction and jointly prepare reports on their investigation, plans of the adjusting actions for the purpose of prevention of such accidents in the future.

2.7. For permission of tasks in these directions of Gosatomregulirovaniya and Gosgorpromnadzor use all available personnel, financial and material resources according to the legislation, and also involve in accordance with the established procedure the international technical assistance and other sources of financing permitted by the legislation.

III. Exchange of information

3.1. Gosatomregulirovaniya and Gosgorpromnadzor are presented by operational data each other concerning the revealed violations of safety requirements at the companies, in organizations, the organizations using nuclear installations, subjects of the address with Russian joint stock company, III and on uranium objects.

3.2. Gosatomregulirovaniya and Gosgorpromnadzor provide access each other to information databases, the concerning questions of implementation of state regulation in the field of labor protection and safety when using nuclear energy.
