About rates of export customs duties by supply of gas from the territory of the Russian Federation on the territory of Ukraine

1. By supply of gas natural in gaseous state (the FEACN CU code 2711 21 000 0) from the territory of the Russian Federation on the territory of Ukraine in amount to 30 billion cubic meters a year in 2010 and to 40 billion cubic meters a year from 2011 to 2019 (inclusive) rates of export customs duties are determined as follows:

a) in case of the level of contract price of gas natural in gaseous state (in US dollars for 1 thousand CBM) taking into account the lowest calorific capability (Рх) below 100/Tr - in the amount of 0 percent,

where Tr - effective rate of export customs duty on gas natural in gaseous state as a percentage, established by the order of the Government of the Russian Federation of December 23, 2006 N 795 "About approval of rates of export customs duties on the goods which are exported from the territory of the Russian Federation out of limits of gosudarstvuchastnik of agreements on the Customs union, and recognition voided some acts of the Government of the Russian Federation", divided into 100 percent;

b) in case of the level of Rkh equal or exceeding 100/Tr, - in the amount of, equal Tr x Rkh - 100 (in US dollars for 1 thousand CBM).

2. Concerning amount of gas natural in gaseous state, delivered from the territory of the Russian Federation on the territory of Ukraine, over 30 billion cubic meters a year in 2010 and over 40 billion cubic meters a year from 2011 to 2019 are (inclusive) applied the rates of export customs duties approved by the order of the Government of the Russian Federation of December 23, 2006 N 795.

3. This resolution extends to the legal relationship which arose since April 1, 2010.
