This Law determines legal, economic, social and organizational basis of tourist activities in the territory of Turkmenistan.

Chapter I. General provisions

Article 1. Purpose of this Law

The purpose of this Law is creation of the legal basis for tourism formation as highly profitable industry of economy and market development of tourist services, employment of the population, increase in currency receipts, protection of the rights and legitimate interests of tourists and subjects of tourist activities, determination of their obligations and responsibility.

Operation of this Law extends to legal entities and physical persons which activities are connected with provision of tourist services, and also on faces which receive them.

Article 2. The basic concepts used in this Law

In this Law the following basic concepts are used:

tourism - travel of physical persons from the permanent residence to the country (place) of temporary stay for rest, in improving, cognitive, professional and business, educational, sports, religious and other purposes, without occupation paid activities;

tourist activities - activities of the legal entities for the organization of travel and the related tourist services, and also the physical persons (registered as individual entrepreneurs), rendering tourist services;

tour - the travel along certain route to specific terms provided with complex of tourist services;

complex tourist service - complex of technologically connected services which appears or offered for rendering to the customer (consumer) for total price as a part of, at least, two services (placement and transportation);

the tourist - the physical person making trip on the territory of Turkmenistan or beyond its limits from twenty four hours to six months or less than twenty four hours, but with one spending the night for rest in improving, cognitive, professional and business, educational, sports, religious and other purposes, without occupation paid activities;

tourist operator activities (tour operator activities) - activities of the legal entities having the license for tourist activities and performing activities for forming, promotion and realization of tourist product to travel agents and tourists. The tour operator has exclusive right to provision of services on the organization of outbound tourism;

tourist agency activities (tourist's agency activities) - activities of the legal entities and physical persons having the license for tourist activities and enabling promotion and the realization of the tourist product on outbound tourism developed by tour operator. The travel agent performs independent activities under the organization of entrance and internal tourism;

tourist services - services of subjects of tourist activities for placement, food, transport, information advertizing to servicing, and also other services directed to requirements satisfaction of the tourist;

tourist resources - climatic, including in especially protected natural territories, and also the historical, welfare, improving objects including subjects to tourist display, and also other objects capable to satisfy spiritual needs of tourists, to promote recovery and development of their physical forces;

tourist product - set of the tourist resources, consumer goods and services intended for realization to the tourist;

the tourist industry - set of automobiles, subjects to placement (accommodation), objects of food and show business, subjects to cognitive, professional and business, improving, educational, sports, religious and other appointment, the organizations performing tour operator and tourist's agency activities and also the organizations providing excursion services and services of guide-interpreters;

objects of the tourist industry - property, property complexes (companies), information, results of intellectual activities, and also the non-material benefits belonging to subjects of the tourist industry on the property right and other legal cause (under the agreement, etc.) and used by them for rendering services. Means of placement and the automobile, trade enterprise, catering establishment, objects of spiritual and material culture, information resources and information systems, means of ensuring of the automated information systems and their technologies belong to objects of the tourist industry;

promotion of tourist product - package of measures (advertizing, participation in specialized exhibitions and fairs, the organization of tourist information centers for realization of tourist products, the edition and distribution of the catalogs, booklets) directed to rendering tourist services;

the guide-interpreter (guide) - professionally prepared physical person rendering excursion and information and organizational services to tourists on acquaintance with tourist resources of Turkmenistan. The guide-interpreter knows language of foreign tourists or language, easily understood for them, the guide knows state language of Turkmenistan or language, easily understood for tourists;

the tourism instructor - professionally prepared physical person having the corresponding qualification and experience of passing of tourist routes across Turkmenistan;

excursion activities - business activity of subjects of the tourist industry on rendering excursion services;

excursion services - services in the organization of travel of physical persons lasting no more than 24 watch (excursion) for the purpose of acquaintance with cultural, historical, architectural and other objects of tourism accompanied by the guide, the guide-interpreter, the other person given the right of holding excursions;

the tourist - the physical person making tour for the purpose of acquaintance with tourist resources in the place of stay during the period which is not exceeding 24 hours;

hotel activities - business activity of subjects of the tourist industry on rendering hotel services;

hotel services - actions (transaction) for placement and temporary residence of consumers (lodgers) in collective and individual means of placement, and also other actions (transactions) connected with placement and temporary residence;

collective means of placement (hotels, motels, etc.) the property complex which is under single management and consisting, at least, of 10 numbers, and in the cases established by the legislation, also classified by category (class) depending on the level of the rendered services and the available equipment;

individual means of placement - the apartment, the room in apartments, at home, the cottages let for rendering tourist services in temporary accommodation of tourists;
