of July 15, 2010 No. 524

About approval of the technical regulation about safety of railway rolling stock

The government of the Russian Federation decides:

1. Approve the enclosed technical regulation about safety of railway rolling stock (further - the technical regulation).

The technical regulation becomes effective in 3 years from the date of official publication of this resolution.

2. To the Ministry of Transport of the Russian Federation in coordination with the interested federal executive bodies about day of entry into force of the technical regulation to prepare the draft of the list of the national standards and (or) sets of rules containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the technical regulation and implementation of assessment of conformity and to provide it in accordance with the established procedure to the Government of the Russian Federation.

3. To Federal Agency for Technical Regulation and Metrology in coordination with the Ministry of Transport of the Russian Federation and the interested federal executive bodies about day of entry into force of the technical regulation to approve the list of national standards and (or) sets of rules as a result of which application on voluntary basis observance of requirements of the technical regulation is provided.

4. To federal executive bodies to bring the regulatory legal acts into accord with the technical regulation.

5. For railway rolling stock and its components which production is in the territory of the Russian Federation finished about day of entry into force of the technical regulation certificates of conformity or declarations of conformity are valid during the effective period specified in them.

6. The realization of this resolution is enabled within the limiting Russian Federation established by the Government of number and the salary fund of workers of the corresponding federal executive body, and also budgetary appropriations provided to it in the federal budget on management and management in the field of the established functions.

The technical regulation about safety of railway rolling stock

I. General provisions

1. This technical regulation is accepted in the following purposes:

a) protection of life or health of citizens, property of physical persons or legal entities, and also state-owned or municipal property;

b) environmental protection, lives or health of animals and plants;

c) the prevention of the actions misleading acquirers;

d) ensuring energy efficiency.

2. Requirements of this technical regulation are obligatory during the designing, production, assessment of conformity of railway rolling stock and its components.

3. Objects of technical regulation of this technical regulation are the railway rolling stocks and its components released in the territory of the Russian Federation for use on railway tracks of general and uncommon use which are again developed (modernized), made (track width - 1520 mm) with speed of movement up to 200 km/h inclusive.

4. The railway rolling stock includes:

a) locomotives;

b) motorvagonny railway vehicles;

c) cars of locomotive draft (further - cars);

d) goods wagons;

e) special railway rolling stock.

5. The list of railway rolling stock and its components is given in the appendix N 1.

6. Action of this technical regulation does not extend to railway rolling stock of technological rail transport.

7. Requirements to operation of railway rolling stock and its components regarding safety of movement are established by the legislation of the Russian Federation on rail transport.

8. Requirements of this technical regulation are obligatory for application and execution:

a) federal executive bodies;

b) the legal entities and physical persons performing designing, production and assessment of conformity of railway rolling stock and its components;

c) owners of infrastructure of rail transport public, owners of railway tracks of uncommon use, owners of railway rolling stock.

9. The legal basis of technical regulation in the field of safety of railway rolling stock and its components are the Federal Law "About Technical Regulation", the Federal Law "About Rail Transport in the Russian Federation", the Federal Law "The Technical Regulation about Requirements of Fire Safety", the Federal Law "About Ensuring Unity of Measurements", this technical regulation, others legislative and regulatory legal acts of the Russian Federation, and also the international agreements of the Russian Federation.

10. The basic concepts used in this technical regulation mean the following:

"emergency kresh-system" - the device of railway rolling stock directed to prevention or decrease in risk of injuring of passengers and service personnel in case of collision and (or) descent of railway rolling stock;

"the automatic locomotive alarm system" - complex of devices for transfer to cabin of the driver of signals of traveling traffic lights which the railway rolling stock approaches;

"automatic brake" - the device providing automatic stop of the train in case of separation or gap of the airwire highway and (or) when opening the crane of emergency brake application (emergency brake);

"safety of railway rolling stock" - condition of railway rolling stock in case of which there is no unacceptable risk connected with damnification of life or to health of citizens, property of physical persons or legal entities, the state-owned or municipal property, and also the environment, life or health of animals and plants;

"release into the stream of commerce" - stage of product lifecycle from production before commissioning;

"dimension of railway rolling stock" - cross perpendicular outline in which, without coming to light, shall be located established on the direct horizontal way (in case of the most adverse provision in track and lack of side inclinations on springs and dynamic fluctuations) axes of way both in empty, and in the loaded condition the railway rolling stock including having most normalized iznosa;

"goods wagons" - the cars intended for transportation of goods such as closed cars, gondola cars, platforms, tank cars, cars of bunker type, rail reefers, grain-carriers, transporters, container carrying ships, special cars of cargo type;

"identification of products" - establishment of the identity of product characteristics provided for obligatory confirmation of conformity, to the characteristics specified in accompanying documents to products;

"rail reefers" - the closed cars with heat insulation intended for transportation of goods, requiring maintenance in certain range of temperature of load during limited interval of time of its delivery;

"innovative products" - products, technical characteristics (functional signs, constructive accomplishment, additional transactions, and also composition of the applied materials and components) or intended use of which are essentially new or significantly differ from the similar earlier made products;

"the driver's cabin" - the part of body of railway rolling stock fenced with partitions in which workplaces of locomotive crew, devices and devices for control of the locomotive, motorvagonny railway vehicles, special railway rolling stock are located;

"capital repairs" - the repair which is carried out for recovery of operability and products resource, complete or close to complete recovery, with replacement or recovery of any its parts including basic;

"constructional speed of railway rolling stock" the largest speed of movement declared in technical documentation on designing;

"the crane of emergency brake application" (emergency brake) - the brake valve serving for release of air from the brake highway of railway rolling stock and actuating of automatic brakes in case of need of the emergency stop;

"locomotive" - the railway rolling stock intended for ensuring movement on railway tracks of trains or separate cars;

"magnetorail brake" - the device creating brake effort by electromagnetic attraction of brake boot to rail;

"upgrade of railway rolling stock" - complex of works on improvement of technical and economic characteristics of the existing railway rolling stock by replacement of its components by more committed;

"upgrade of railway rolling stock with prolongation of service life" - complex of works on improvement of technical and economic characteristics of the existing railway rolling stock by entering into basic design of changes for the purpose of prolongation of service life;

"motorvagonny railway vehicles" - motor and not motor cars of which electric trains, the diesel train, railcars, rail buses, diesel electric train, elektromotrisa intended for transportation of passengers and (or) baggage, mail are created;

"the appointed resource" - total operating time of products in case of which achievement its operation shall be stopped irrespective of technical condition;

"the appointed service life" - the calendar duration of operation of products in case of which achievement operation of products shall be stopped irrespective of its technical condition;

"the appointed storage duration" - calendar storage life of products in case of which achievement storage of products shall be stopped irrespective of its technical condition;

"cars" - the cars intended for transportation of passengers and (or) baggage, mailings such, as post, luggage, dining-cars, office and technical, office, clubs, sanitary, test and measuring laboratories, special cars of passenger type;

"passport" - the document containing the data certifying manufacturer's guarantees, values of key parameters and characteristics (properties) of products, and also data on certification and utilization of products;

"pneumatic brake" - air-controlled brake;

"under control operation" - the regular operation of railway rolling stock which is followed by additional control and accounting of technical condition of railway rolling stock;

"train" - the created and linked structure of cars with one or several operating locomotives or motor cars, having established signals and also sent to stage and which are on stage locomotives without cars and special self-propelled railway rolling stock;

"products" - railway rolling stock and (or) its components;

"recuperative braking" - the braking of railway rolling stock performed by means of electrodynamic brake in case of which the electrical energy released in case of transfer of traction electric motors in the generating mode is transferred to contact network;

"operation manual" - the document containing the data on design, the principle of action, characteristics (properties) of products and specifying necessary for the correct and safe operation of products (proper use, maintenance, running repair, storage and transportation) and estimates of its technical condition in case of determination of need of sending it in repair, and also data on utilization of products;

"high-speed railway rolling stock" - the locomotives, cars, motorvagonny railway vehicles intended for ensuring implementation of transportations with movement speed in the range from 141 to 200 km/h;

"component of railway rolling stock" - the detail, assembly unit or their set entering design of railway rolling stock and providing its safe operation, safety of service personnel and (or) passengers;

"special railway rolling stock" - the railway rolling stock intended for ensuring construction and functioning of infrastructure of rail transport and including fixed self-propelled mobile units on railway to the course, such as autonomous cars, section cars, special railcars, railway and construction machines with the autonomous engine and the traction drive and also not self-propelled mobile units on railway to the course, such as railway and construction machines without traction drive, trail cars and the special railway rolling stock included in economic trains and intended for works on content, servicing and repair of constructions and devices of the railroads;

"parking brake" - the device with the manual or automatic drive located on unit of railway rolling stock and intended for its fixing on the parking from spontaneous leaving and also for forced emergency stop in the presence of the manual or automatic drive in unit of railway rolling stock;

"technical compatibility" - capability of railway rolling stock to interaction with each other and with infrastructure of rail transport according to the requirements established by this technical regulation;

"braking of railway rolling stock" - impact on devices and devices for control of the brake system for the purpose of reduction of speed or stop of the moving train;

"brake way" - the distance passed by train in time from the impact moment on devices and devices for control of the brake system including operations of the crane of emergency brake application (emergency brake), to complete stop;

"form" - the document containing the data certifying manufacturer's guarantees, values of key parameters and characteristics (properties) of products reflecting technical condition of the specified products, data on certification and utilization of products, and also data which enter during the period of its operation (duration and working conditions, maintenance, repair, etc.);

"operational documentation" - design documentation which separately or in total with other documentation determines service regulations of products and (or) reflects the data certifying the values of key parameters and characteristics (properties) of products, and also guarantee and the data guaranteed by the manufacturer on its operation during fixed term of service;

"emergency brake application" - the braking applied in the cases requiring immediate stop of the train by use of the maximum brake force;

"electrodynamic brake" - the device in which force of braking is created when transforming kinetic energy of the train to electrical energy by transfer of traction electric motors in the generating mode;

"electric air brake" - the braking device with electric management of pneumatic brakes.

11. Products which are exposed to procedures of obligatory confirmation of conformity according to provisions of this technical regulation shall be identified.

Identification of products is carried out when sampling and testing, and also for the certificate that the provided samples really belong to products which are subject to obligatory confirmation of conformity.

Identification of products is carried out according to the submitted documentation and (or) visually.

Identification of products consists in comparison of the main characteristics of product samples with the main characteristics specified in the request for carrying out obligatory confirmation of conformity of products, technical (accompanying) documentation for it, marking on product sample and on packaging (container). For carrying out identification of products the characteristics provided in national standards and (or) sets of rules which list affirms Federal Agency for Technical Regulation and Metrology (further - documents on standardization), and also in the All-Russian Product Classifier and design documentation, including specifications and delivery agreements can be used.

In case of visual identification products type, the location, availability and contents of information for the consumer are determined.

Results of identification when carrying out testing are reflected in the test report (test report).

12. This technical regulation taking into account risk degree of damnification establishes minimum necessary requirements to railway rolling stock and its components which accomplishment provides:

a) safety of radiations;

b) biological safety;

c) explosion safety;

d) mechanical safety;

e) fire safety;

e) thermal safety;

g) chemical safety;

h) electric safety;

i) electromagnetic compatibility regarding safety of operation of devices and the equipment;

j) unity of measurements.

13. In case of production the manufacturer shall execute all package of measures for execution of the requirements determined by this technical regulation.

14. The made products which are subject to obligatory confirmation of conformity before release into the stream of commerce undergo acceptance review according to technical documentation.

15. Results of acceptance review are reported for implementation of state registration of railway rolling stock, decision making about its admission on infrastructure of rail transport and if necessary to state control (supervision) bodies.

16. Ensuring admissible values of safety of railway rolling stock and its components (further - admissible values) provided by the documents on standardization applied on voluntary basis is sufficient condition of observance of requirements of this technical regulation.

II. Requirements to railway rolling stock and its components during the designing and production

17. When designing railway rolling stock and its components the risk degree in the settlement, experimental and expert way, including based on data of operation of similar products shall be estimated. Evaluation methods of risk degree can be established in documents on standardization.

18. Safety of railway rolling stock and its components shall be provided in the way:

a) implementation of complex of research and development works when designing products;

b) applications of the approved technical solutions;

c) establishments of the appointed service life and (or) resources of products, and also carrying out maintenance and repairs with necessary frequency;

d) carrying out complex of the calculations based on the approved techniques;

e) the choice of the materials and substances applied during the designing and production depending on parameters and service conditions;

e) establishments of extreme criteria of conditions of products;

g) determinations of conditions and methods of utilization of products;

h) evaluating compliance of products.

19. The railway rolling stock and its components on durability, stability and technical condition shall provide safe train service with the largest speeds within admissible values.

20. The railway rolling stock and its components shall provide:

a) observance of dimension of railway rolling stock;
