About confidential inventions
This Law regulates the property and related personal non-property relations arising in connection with creation, legal protection and use of confidential inventions in the territory of the Republic of Tajikistan.
In this Law the following concepts are used:
- the statement - set of the documents determined by this Law, represented to Patent authority for receipt of the security document;
- confidential inventions and researches - the inventions containing the data which are the state secret and recognized confidential according to the procedure, established by this Law;
- secret sites of industrial property - the invention, industrial designs and useful models containing the data which are the state secret and being product of intellectual activities of the person;
- patentability conditions - the conditions of provision of legal protection provided by this Law to the invention;
- invention analog - the object having the appointment, identical with the invention, characterized by set of the signs similar to set of essential signs of the invention;
- security documents - the patents or small patents for the confidential invention granted according to this Law;
- equipment level - set of the data which became public in the world before priority date of the invention.
The legislation of the Republic of Tajikistan on confidential inventions is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.
