Chapter I. General provisions

Article 1. Concept of trade secret

The trade secret is the information which is not the state secret, connected with economic, financial, productive, technological and other activity of the company, organization, organization or the individual entrepreneur, disclosure (transfer, leakage) of which can cause damage to their activities and interests.

Article 2. Legislation of Turkmenistan on trade secret

1. The legislation of Turkmenistan on trade secret is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.

2. Legal protection of trade secret of foreign legal entities, their branches and representations, and also citizens of foreign states, the stateless persons performing activities in the territory of Turkmenistan is provided according to the legislation of Turkmenistan.

Article 3. Coverage of this Law

1. This Law extends to citizens of Turkmenistan, citizens of foreign states, stateless persons, legal entities, branches, the representations of legal entities which are in the territory of Turkmenistan in ownership, use and which order there is information which is trade secret (owners hereinafter are referred to as further).

2. Operation of this Law extends also to faces to which such information became known in accordance with the established procedure.

Article 4. Requirements to information which is trade secret
