About procedure for application of measure of criminal penalty in the form of assignment of obligation of accommodation in certain area

For the purpose of implementation of measures for humanization of criminal legal policy of Turkmenistan:

1. In case of assignment of punishment in the form of assignment of obligation of accommodation in certain area as primary punishment or when replacing unexpired part of the punishment connected with imprisonment, punishment in the form of assignment of obligation of accommodation in certain area court considers opinion of state governing bodies, public organizations, and also hyakim of welayats and the city of Ashgabat on feasibility of application of such type of punishment. At the same time the specified opinion is expressed in writing and signed by the head of public authority or management, public organizations in which system the defendant or the convict, and also hyakimy the welayat or the city of Ashgabat in the place of consideration of the question connected using punishment in the form of assignment of obligation of accommodation in certain area worked.

2. Places of serving sentence in the form of assignment of obligation of accommodation in certain area are determined by the President of Turkmenistan.
