About some measures for streamlining of land relations in Turkmenistan

For the purpose of enhancement of procedure for provision of lands in private property, long-term lease and for maintaining home economy, and also further regulation of land relations I decide:

1. Prohibit hyakimlika of welayats, Ashgabat and etraps provision of lands in private property and long-term lease to subjects of land relations, irrespective of patterns of ownership and departmental subordination, and also for maintaining home economy, arrangement of individual housing, garden and seasonal dachas.

2. Determine that provision of lands in private property and long-term lease to subjects of land relations is performed according to the decision of the Cabinet of Ministers of Turkmenistan on representation to State commission of Turkmenistan on holding land reform in the following procedure:

in private property and long-term lease - according to applications of subjects of land relations which are considered by hyakimlika of the etrap, the welayat and State commission on land reform of Turkmenistan;

for maintaining home economy, arrangement of individual housing, garden and seasonal dachas - according to petitions from citizens which are considered by gengeshlik archina together with elders of the village, hyakimlikama of the etrap, Ashgabat and the welayat and State commission on land reform of Turkmenistan.

Lands for the specified categories of land owners are provided from the special land fund which is annually approved by the Cabinet of Ministers of Turkmenistan.

3. Determine that the lands provided to land owners and land users irrespective of the provided direction of their use, in case of their non-use within two years or use not to destination are subject to withdrawal in accordance with the established procedure.
