The law of Ukraine of 11.07.96 N 313/96-BP "About rates of the excise duty and import duty for some goods (products)" which was published on August 1, 1996 in N 141 Golos Ukrainy newspapers and became effective in 10 days after publication, i.e. since August 12 of the current year on separate goods of foreign origin and national production excise duty rates are established.

At the same time the specified Law provides taxation by the excise duty of products which at the time of the introduction in operation of the specified Law were not excisable. Therefore in case of acquisition of wholesale and retail trade of separate newly introduced excise goods by the companies (guns sports, hunting, rifles sports, hunting, parts of carcasses of poultry, gasoline motor, heavy distillates (diesel fuel), audio cassettes, compact disks, furniture for sitting, office furniture, etc.) which till 12.08.96 were not excisable and for the specified date stayed on balance of the companies of wholesale and retail trade as remaining balance of unrealized products, realization of such remaining balance (which since 12.08.96 filled up the list of excise goods) by trade enterprises it is performed at the prices without the excise duty.

This procedure does not extend to the excisable products acquired till January 1, 1992 and also to the goods acquired till February 18, 1994. Taxable turnover from realization of such products is determined according to the procedure, provided by Art. 4 of the Decree of the Cabinet of Ministers of Ukraine of 26.12.92 N 18-92 "About the excise duty".
