1. Approve Regulations on customs regime of refusal for benefit of the state.

2. Send this order to customs of Turkmenistan for execution.

3. To impose control of execution of this order on the vice-chairman of the State Customs Service of Turkmenistan A. Mukhammetkuliyev.

Regulations on customs regime of refusal for benefit of the state

I. General provisions

1.1. Refusal for benefit of the state - customs regime in case of which the goods imported on customs area of Turkmenistan and which are under customs control are gratuitously transferred to the possession of the state without tax payment, customs duties and application of the measures of economic regulation established by the legislation of Turkmenistan.

1.2. For the purposes of this provision goods are understood as any, the property moved through customs border of Turkmenistan (except electric, thermal and other types of energy), including vehicles.

II. The bases for the goods circulation in property of the state

2.1. In case of customs regime of refusal for benefit of the state the basis for the goods circulation in property of the state is the official (written) appeal to customs authority of person in whose property there are such goods.

2.2. Under customs regime of refusal for benefit of the state goods which turnover is prohibited according to the legislation of Turkmenistan cannot be located.
