According to Articles 6, of 8, of 9, 20 Laws of Ukraine "About licensing of certain types of economic activity", Item 1 of the resolution of the Cabinet of Ministers of Ukraine of 03.07.2006 N 895 "Questions of holographic protection of documents and goods", Items, 3, of 4, of 24, 49 Regulations on procedure for holographic protection of documents and goods, the Cabinet of Ministers of Ukraine approved by the resolution, of 24.02.2001 N 171, the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 N 1698 "About approval of the list of bodies of licensing" and for the purpose of ensuring legal regulation of activities in the field of holographic protection I ORDER:

1. Approve applied:

Licensed conditions of conducting economic activity on development, production and certified testing of holographic protective elements;

Procedure for control of observance of Licensed conditions of implementation of economic activity on development, production and certified testing of holographic protective elements.

2. Determine that licenses for the right of conducting economic activity on development, production and certified testing of holographic protective elements which are issued by Department of special telecommunication systems and information security of the Security Service of Ukraine are effective before completion of term of their action and are subject to renewal only in the cases determined by the legislation of Ukraine.

3. To department on control of production of securities, excise stamps, documents of the strict reporting and holographic protective elements (Gosznak) (Kozimenko A. V.), in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

4. To impose control over the implementation of this order on the deputy minister Shevchenko Yu. I.

5. This order becomes effective from the date of official publication.

Licensed conditions of conducting economic activity on development, production and certified testing of holographic protective elements

I. General provisions

1. These Licensed conditions developed according to article 8 of the Law of Ukraine "About licensing of certain types of economic activity", article 20 of the Law of Ukraine "About the state secret", resolutions of the Cabinet of Ministers of Ukraine of 03.07.2006 N 895 "Questions of holographic protection of documents and goods", of 24.02.2001 N 171 "About approval of the Regulations on procedure for holographic protection of documents and goods", of 14.11.2000 N 1698 "About approval of the list of bodies of licensing" determine organizational, qualification, production and other requirements to subjects of housekeeping which accomplishment is the compulsory provision of conducting economic activity on development, production and certified testing of holographic protective elements (further - GZE).

2. Action of these Licensed conditions extends to all subjects of housekeeping irrespective of pattern of ownership who perform activities for development, production and certified testing of GZE.

3. The license for conducting economic activity on development, production and certified testing of GZE, is issued for five years with indication of separate works which can be carried out within type of economic activity, namely:

development of holographic protective elements;

production of holographic protective elements;

certified testing of holographic protective elements.

4. For receipt of the license for the activities noted in Item 3 of this Section in full or partially the subject of housekeeping submits in the Ministry of Finance of Ukraine the application in the established form (appendix). Documents according to article 10 of the Law of Ukraine "About licensing of certain types of economic activity" and documents which exhaustive list is established by the Cabinet of Ministers of Ukraine are enclosed to the application.

5. The subject of housekeeping shall adhere to the procedure for acceptance and registration of citizens established by the legislation for work according to requirements of Chapter III of the Labor code of Ukraine.

II. Requirements to conducting economic activity on development, production and certified testing of GZE

1. Regime requirements

The subject of housekeeping shall have:

division or person responsible for observance of requirements of the mode of protection of the company;

regime and confidential department or person who is responsible for observance of the state or trade secret in case of development, production, carrying out certified testing of GZE;

the instruction concerning the organization of the access and inside control on production (site).

2. Production requirements

2.1. Conducting activities for development, production and certified testing of GZE, is performed by subjects of housekeeping according to requirements of the Regulations on procedure for holographic protection of documents and goods approved by the resolution of the Cabinet of Ministers of Ukraine, of 24.02.2001 N 171.
