About approval of forms of accounting and submission of information connected with implementation of financial monitoring, and the Instruction for their filling
According to Articles 6, of 10, of 12, 17 and 18 Laws of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way or to terrorism financing" ORDER:
1. Approve such forms of accounting and submission of information connected with implementation of financial monitoring which are provided by subjects of primary financial monitoring (except banks/branches of foreign banks) and (are applied) by their separate divisions:
No. 1-FM ("Form of accounting of the subject of primary financial monitoring (separate division)" for insurers (overcautious persons), credit unions, pawnshops and other financial institutions; payment institutes and members of payment service providers which are non-bank organizations; acquiring and clearing organizations; commodity, stock and other exchanges; professional participants of the security market; the companies on asset management; operators of mail service, other organizations who perform financial operations on money transfer; subjects of managing which hold lotteries and gamblings, including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes; other legal entities who on the legal status are not financial institutions, but provide separate financial services;
No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" - for specially certain subjects of primary financial monitoring who perform the activities solely, without formation of legal entity, namely: subjects of business activity which provide intermediary services when implementing transactions of purchase and sale of real estate in case of establishment of business relations with the client who intends to make the transaction concerning purchase and sale of the real estate, on the amount which equals or exceeds 400000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency; subjects of managing which perform trade in precious metals and gemstones and products from them for cash (in particular precious metals, gemstones, antiquarian things, objects of art and so forth) or during the organization of trade in such objects, including auction if the amount on which operation is performed equals or exceeds 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency; lawyers; auditors; notaries, physical persons - entrepreneurs who provide legal services, physical persons - the entrepreneurs providing services in financial accounting in case of establishment of business relations with the client who has intention to make one of the transactions determined by part one of article 8 of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way or to terrorism financing"; physical persons - entrepreneurs who perform financial operations with goods (perform works, provide services) for cash, in case of carrying out financial transaction on the amount which equals or are exceeded by 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency (dalsheedinolichnik);
No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" - for specially certain subjects of primary financial monitoring (except individualists, legal entities who perform financial operations with goods (perform works, provide services) for cash, in case of carrying out financial transaction on the amount which equals or are exceeded by 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency, and subjects of managing which hold lotteries and gamblings, including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes);
No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" - for specially certain subjects of primary financial monitoring - legal entities who perform financial operations with goods (perform works, provide services) for cash, in case of carrying out financial transaction on the amount which equals or exceeds 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency;
No. 2-FM "The register of the financial transactions which are subject to financial monitoring" - for insurers (overcautious persons), credit unions, pawnshops and other financial institutions; payment institutes and members of payment service providers which are non-bank organizations; acquiring and clearing organizations; commodity, stock and other exchanges; professional participants of the security market; the companies on asset management; operators of mail service, other organizations who perform financial operations on money transfer; subjects of managing which hold lotteries and gamblings, including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes; other legal entities who on the legal status are not financial institutions, but provide separate financial services;
No. 2-FM "The register of the financial transactions which are subject to financial monitoring" - for individualists;
No. 2-FM "The register of the financial transactions which are subject to financial monitoring" - for specially certain subjects of primary financial monitoring (except individualists, legal entities who perform financial operations with goods (perform works, provide services) for cash, in case of carrying out financial transaction on the amount which equals or are exceeded by 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency, and subjects of managing which hold lotteries and gamblings, including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes);
No. 2-FM "The register of the financial transactions which are subject to financial monitoring" - for specially certain subjects of primary financial monitoring - legal entities who perform financial operations with goods (perform works, provide services) for cash, in case of carrying out financial transaction on the amount which equals or exceeds 150000 hryvnias or equals or exceeds the amount equivalent specified, in foreign currency;
No. 3-FM "Message on results of processing of form of accounting of the subject of primary financial monitoring (separate division)";
No. 4-FM "Message on the financial transactions which are subject to financial monitoring";
No. 5-FM "The message on capture of financial transaction on accounting or about refusal of capture on accounting by Gosfinmonitoring";
No. 6-FM "Request about provision of the additional information concerning financial monitoring".
2. Determine that the branches or representative offices of foreign business entities which are non-bank organizations which provide financial services in the territory of Ukraine give to Gosfinmonitoring forms of accounting and submission of information connected with implementation of financial monitoring on forms No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" and No. 2-FM "The register of the financial transactions which are subject to financial monitoring" according to the type of activity.
3. Determine that the form No. 4-FM "The message on the financial transactions which are subject to financial monitoring" specially certain subjects of primary financial monitoring (except for subjects of managing which hold lotteries and gamblings including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes) does not move.
4. Approve the Instruction for filling of forms of accounting and submission of information connected with implementation of financial monitoring it (is applied).
5. Determine that forms of accounting and submission of information connected with implementation of financial monitoring are used by subjects of primary financial monitoring and their separate divisions which are not banks/branches of foreign banks, in such cases:
form No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" and form No. 4-FM "The message on the financial transactions which are subject to financial monitoring" - in case of submission of information to Gosfinmonitoring on papers and in other cases established by Gosfinmonitoring;
form No. 2-FM "Register of the financial transactions which are subject to financial monitoring":
in case of registration of the financial transactions which are subject to financial monitoring if the register is kept in paper form;
in case of printout of the register of the financial transactions which are subject to financial monitoring if the register is kept electronically;
in case of submission of information to Gosfinmonitoring on papers;
form No. 3-FM "The message on results of processing of form of accounting of the subject of primary financial monitoring (separate division)", form No. 5-FM "The message on capture of financial transaction on accounting or about refusal of capture on accounting by Gosfinmonitoring" - by provision Gosfinmonitoringy messages on results of information processing which arrived from subjects of primary financial monitoring;
form No. 6-FM "Request about provision of the additional information concerning financial monitoring" - in case of the direction Gosfinmonitoringy to the subject of primary financial monitoring of request about provision of the additional information according to requirements of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way or to terrorism financing".
6. Determine that in case of submission of information by subjects of primary financial monitoring in electronic form such subjects provide submission of information according to structure of details and structures of the files approved by Gosfinmonitoring.
7. Declare invalid the order of State department of financial monitoring of the Ministry of Finance of Ukraine of 13.05.2003 No. 48 "About approval of some forms of accounting and submission of information connected with implementation of financial monitoring, and the Instruction for their filling", registered in the Ministry of Justice of Ukraine 23.05.2003 for No. 394/7715 (with changes).
8. To department of interaction and coordination of system of financial monitoring (Kovalchuk A. T.) together with Legal management (Gajewski I. M.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.
9. This order becomes effective from the date of its official publication.
10. To impose control over the implementation of this order on the vice-chairman of the State committee of financial monitoring of Ukraine Sakhnenko O. M.

Approved by the Order of the State committee of financial monitoring of Ukraine of August 26, 2010 No. 148
1. By provision by subjects of primary financial monitoring of information to the State committee of financial monitoring of Ukraine (further - Gosfinmonitoring) according to the corresponding forms on paper filled forms of forms move to Gosfinmonitoring: Ulitsa Belorusskaya, 24, Kiev, 04655, MSP 655, in the unpacked type or are filled by means of the handle is legible printing letters black or blue ink (for forms with manual method of filling).
2. Standard forms in the PDF or Excel format for provision of information to Gosfinmonitoring can be received on the official website of the State committee of financial monitoring of Ukraine to the address: http://www.sdfm.gov.ua. By provision of information to Gosfinmonitoring it is forbidden to change format of forms, their geometrical sizes and the sizes of entry fields of information.
3. When filling forms it is necessary to use such general rules:
fields which shall be filled by means of codes are filled with use of the corresponding reference books of codes;
if fields are broken into sections, in each section one symbol (one printing letter, figure or other sign) is placed;
if on any the reasons in certain fields information is absent, in them the symbol "-" (crossed out section) is put if the respective field is broken into sections, then the crossed out section is put down in all sections;
if in the field broken into sections there are free cages, then in free cages to the left of the first figure the symbol "-" is put down (crossed out section).
Fields which contain the data established as a result of identification of persons and the description of financial transaction, purpose of payment are filled only on the basis and in language of the provided originals of documents (or properly verified copies). Other fields which are provided to be filled with the text are filled in Ukrainian.
4. In this Instruction the term "Accounting Identifier" is used in such value - it is combination from letters of the Latin alphabet and figures which Gosfinmonitoring appropriates to the subject in case of capture it on accounting and which is used by it during execution of obligations according to the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, or to terrorism financing", including registration and submissions of information to Gosfinmonitoring, representations of requests in state bodies concerning identification of clients and in others, the cases determined by the legislation.
5. In this Instruction such reducings in the corresponding case and number are used:
OP - separate division;
GRFL - The state register of physical persons - taxpayers and other obligatory payments;
EGRPOU - Unified state register of the companies and organizations of Ukraine;
SPFM - the subject of primary financial monitoring;
FO - financial transaction.
The form No. 1-FM "Form of accounting of the subject of primary financial monitoring (separate division)" (the form No. 1-FM is farther) moves to Gosfinmonitoring directly all subjects of primary financial monitoring.
1. Procedure for filling of form No. 1-FM with subjects of primary financial monitoring, namely: insurers (overcautious persons), credit unions, pawnshops and other financial institutions; payment institutes and members of payment service providers which are non-bank organizations, acquiring and clearing organizations; commodity, stock and other exchanges; professional participants of the security market; the companies on asset management; operators of mail service, other organizations which perform financial operations on money transfer; subjects of managing which hold lotteries and gamblings, including casino, electronic (virtual) casino, in case of carrying out the financial transaction connected with acceptance or return of rates or payment of prizes; other legal entities who on the legal status are not financial institutions, but provide separate financial services 1.1. The specified subjects give the corresponding form No. 1-FM in such cases:
in case of registration of the subject of primary financial monitoring in the Single state information system in the field of prevention and counteraction of legalization (washing) of the income and to terrorism financing (further - the Unified information system);
in case of change of the general and additional information about the subject of primary financial monitoring, including about the ranking officer for carrying out financial monitoring and/or person who temporarily fulfills its duties in the subject of primary financial monitoring;
in case of the termination of activities of the subject of primary financial monitoring;
in case of renewal of activities of the subject of primary financial monitoring.
Besides, the form No. 1-FM moves to Gosfinmonitoring directly the subject of primary financial monitoring in such cases:
in case of submission of information on separate division of the subject of primary financial monitoring;
in case of change of data on separate division, including about the ranking officer for carrying out financial monitoring and/or person who temporarily fulfills its duties in separate division;
in case of the termination of activities of separate division;
in case of renewal of activities of separate division.
1.2. The corresponding form No. 1-FM is filled with the mentioned subjects of primary financial monitoring by such rules:
if the form No. 1-FM with the information about the subject of primary financial monitoring and appointment of the ranking officer (or persons who temporarily fulfills its duties) the subject of primary financial monitoring is sent for the first time, Sections I, II, III and V are filled in, at the same time in the field 040 "Type of the message (code)" of the Section I the code of type of the message "primary" without filling of the field 050 "SPFM accounting identifier" is specified;
when filling form No. 1-FM with data on separate division of the subject of primary financial monitoring and appointment or release of the ranking officer (or persons who temporarily fulfills its duties) separate division Sections I, IV and V are filled in. The fields 010-031, 050 "SPFM accounting identifier" of the Section I are filled with details of the subject of primary financial monitoring. If the form No. 1-FM for the relevant separate division is sent for the first time, in the field 040 "Type of the message (code)" of the Section I the code of type of the message "primary" is specified, the field 051 "The accounting identifier of separate division" is not filled, in the field 060 "Type of the subject (code)" details of separate division are specified. In case of submission of the adjusting message with data on separate division in the field 040 "Type of the message (code)" of the Section I the code of type of the message "adjusting" is specified, in fields 051 "The accounting identifier of separate division" and 060 "Type of the subject (code)" details of separate division are specified;
the Section I is filled in surely in all cases of representation of form No. 1-FM to Gosfinmonitoring;
Sections II and III of form No. 1-FM are filled in with the information about the subject of primary financial monitoring in case of the first representation to Gosfinmonitoring of form No. 1-FM and in case of change of one of the details of the subject of primary financial monitoring specified in these Sections or in case of the termination (renewal) of activities of the subject of primary financial monitoring;
the Section IV is filled in in case of submission of data on separate division of the subject of primary financial monitoring, in case of the first and the subsequent submissions of data on appointment or release of the ranking officer (or persons who temporarily fulfills its duties) in separate division and in case of change of one of the details of separate division specified in this Section or in case of the termination (renewal) of activities of separate division;
the Section V is filled in for the subject of primary financial monitoring and respectively for separate division in case of the first and the subsequent submissions of data on appointment or release of the ranking officer, or person who temporarily fulfills its duties, or the head of the subject of primary financial monitoring (separate division). Items 1, of 2, 3 Sections V in case of need can be filled at the same time, but only rather ranking officer (or persons who temporarily fulfills its duties) the subject of primary financial monitoring or the ranking officer (or faces which temporarily fulfill its duties) separate division of this subject;
in case of change of the general and additional information about the subject of primary financial monitoring in Sections II, III or about responsible (responsible) the worker (workers) (Section V) only that field in which there were any changes, the field 040 "Type of the message (code)" in this case are filled it is coded by adjusting value. In case of change of the separate details of separate division of the subject of primary financial monitoring specified in the Section IV or V fields 320, 330 surely are specified and fields in which there were changes, the field 040 "Type of the message (code)" in this case it is coded by adjusting value. In case of absence at separate division of own identification code on EGRPOU the code on EGRPOU of the subject of primary financial monitoring is specified.
